1 (1) Where floodway and flood fringe districts are delineated on the floodplain maps, the <br />2 standards in sections 923 or 924 will apply, depending on the location of a property. <br />3 (2) Locations where floodway and flood fringe districts are not delineated on the floodplain maps <br />4 are considered to fall within the general floodplain district. Within the general floodplain <br />5 district, the floodway district standards in section 923 apply unless the floodway boundary is <br />6 determined, according to the process outlined in section 925. Once the floodway boundary is <br />7 determined, the flood fringe district standards in section 924 may apply outside the floodway. <br />8 (B) Lands to which this subdivision applies. This subdivision applies to all lands within the jurisdiction of <br />9 the city shown on the official zoning map and/or the attachments to the map as being located within <br />10 the boundaries of the floodway, flood fringe, or general floodplain districts. <br />11 (1) The floodway, flood fringe and general floodplain districts are overlay districts that are <br />12 superimposed on all existing zoning districts. The standards imposed in the overlay districts <br />13 are in addition to any other requirements in the underlying zoning district. In case of a conflict, <br />14 the more restrictive standards will apply. <br />15 (C) Incorporation of maps by reference. The following maps, together with all attached material, are <br />16 hereby adopted by reference and declared to be a part of the official zoning map and this <br />17 subdivision. The attached material includes the Flood Insurance Study for Anoka County, <br />18 Minnesota, and Incorporated Areas and the flood insurance rate maps enumerated below, all dated <br />19 December 16, 2015 and all prepared by the Federal Emergency Management Agency. The regulatory flood protection elevation (RFPE) is an <br />24 elevation no lower than one foot above the elevation of the regional flood plus any increases in <br />25 flood elevation caused by encroachments on the floodplain that result from designation of a <br />26 floodway. <br />27 (E) Interpretation. The boundaries of the zoning districts are determined by scaling distances on the <br />28 flood insurance rate map. <br />29 (1) Where a conflict exists between the floodplain limits illustrated on the official zoning map and <br />30 actual field conditions, the flood elevations shall be the governing factor. The zoning <br />31 administrator must interpret the boundary location based on the ground elevations that <br />32 existed on the site on the date of the first National Flood Insurance Program map showing the <br />33 area within the regulatory floodplain, and other available technical data. <br />34 (2) Persons contesting the location of the district boundaries will be given a reasonable <br />35 opportunity to present their case to the planning commission and to submit technical <br />36 evidence. <br />37 (F) Abrogation and greater restrictions. It is not intended by this subdivision to repeal, abrogate, or <br />38 impair any existing easements, covenants, or other private agreements. However, where this <br />39 subdivision imposes greater restrictions, the provisions of this subdivision prevail. <br />40 (G) Warning and disclaimer of liability. This subdivision does not imply that areas outside the floodplain <br />41 districts or land uses permitted within such districts will be free from flooding or flood damages. <br />42 This subdivision does not create liability on the part of the city or its officers or employees for any <br />Page 119 of 160 <br />
