1 a. All service utilities, including ductwork, must be elevated or water -tight to prevent infiltration <br />2 of floodwaters. <br />3 b. As an alternative to elevation on fill, an accessory structure that constitutes a minimal <br />4 investment and that does not exceed 576 square feet in size may be internally floodproofed <br />5 in accordance with section 923(D)(3). <br />6 (2) The cumulative placement of fill or similar material on a parcel must not exceed 1,000 cubic <br />7 yards, unless the fill is specifically intended to elevate a structure in accordance with subsection <br />8 (a) above, or if allowed as a conditional use under section 924(C)(3) below. <br />9 (3) The storage of any materials or equipment must be elevated on fill to the regulatory flood <br />10 protection elevation. <br />11 (4) The storage or processing of materials that are, in time of flooding, flammable, explosive, or <br />12 potentially injurious to human, animal, or plant life is prohibited. <br />13 (5) Fill must be properly compacted and the slopes must be properly protected by the use of riprap, <br />14 vegetative cover or other acceptable method. <br />15 (6) All new principal structures must have vehicular access at or above an elevation not more than <br />16 two feet below the regulatory flood protection elevation, or must have a flood <br />17 warning/emergency evacuation plan acceptable to the city. <br />18 (7) Accessory uses such as yards, railroad tracks, and parking lots may be at an elevation lower <br />19 than the regulatory flood protection elevation. However, any facilities used by employees or <br />20 the general public must be designed with a flood warning system that provides adequate time <br />21 for evacuation if the area is inundated to a depth and velocity such that the depth (in feet) <br />22 multiplied by the velocity (in feet per second) would exceed a product of four upon occurrence <br />23 of the regional (one percent chance) flood. <br />24 (8) Interference with normal manufacturing/industrial plant operations must be minimized, <br />25 especially along streams having protracted flood durations. In considering permit applications, <br />26 due consideration must be given to the needs of industries with operations that require a <br />27 floodplain location. <br />28 (9) Flood fringe developments must not adversely affect the hydraulic capacity of the channel and <br />29 adjoining floodplain of any tributary watercourse or drainage system. <br />30 (10) Manufactured homes and recreational vehicles must meet the standards of section 927. <br />31 (C) Conditional uses. The following uses and activities may be allowed as conditional uses, if allowed in <br />32 the underlying zoning district(s) or any applicable overlay district, following the procedures in section <br />33 928(D). conditional uses must meet the standards in subsections (D)(4) through (10) above and <br />34 section 924(D). <br />35 (1) Any structure that is not elevated on fill or floodproofed in accordance with section 924(B)(1)a. <br />36 and b. <br />37 (2) Storage of any material or equipment below the regulatory flood protection elevation. <br />38 (3) The cumulative placement of more than 1,000 cubic yards of fill when the fill is not being used <br />39 to elevate a structure in accordance with [subsection] (b)(1) above. <br />40 (D) Standards for flood fringe conditional uses. <br />41 (1) The standards listed in sections 924(6)(4) through (10) apply to all conditional uses. <br />42 (2) Basements, as defined in section 105, are subject to the following: <br />43 a. Residential basement construction is not allowed below the regulatory flood protection <br />44 elevation. <br />45 b. Non-residential basements may be allowed below the regulatory flood protection elevation <br />46 provided the basement is structurally dry floodproofed in accordance with section 924(D)(3). <br />47 (3) All areas of nonresidential structures, including basements, to be placed below the regulatory <br />48 flood protection elevation must be floodproofed in accordance with the structurally dry <br />49 floodproofing classifications in the Minnesota State Building Code.
