Residential subdivisions with dwelling unit densities exceeding those in the tables in <br />4 subsections (e)(2) and (3) of this section can only be allowed if designed and approved <br />5 as residential planned unit developments under section 117-227. Only land above the <br />6 ordinary high water level of public waters can be used to meet lot area standards, and <br />7 lot width standards must be met at both the ordinary high water level and at the <br />8 building line. The sewer lot area dimensions in subsection (e)(2) of this section can only <br />9 be used if publicly owned sewer system service is available to the property. <br />10 b. Subdivisions of double, triple, and quad unit buildings on natural environment lakes <br />11 must also meet the following standards: <br />12 1. Each building must be set back at least 200 feet from the ordinary high water <br />13 level; <br />14 2. Each building must have common sewage treatment and water systems in one <br />15 location and serve all dwelling units in the building; <br />16 3. Watercraft docking facilities for each lot must be centralized in one location and <br />17 serve all dwelling units in the building; and <br />18 4. No more than 25 percent of a lake's shoreline can be in duplex, triplex, or quad <br />19 developments. <br />20 c. Accessory Dwelling Units One guest cottage may bc allowed on lots mccting or <br />21 cxcccding thc duplex lot arca and width dimcnsions presented in subsections (c)(1) <br />22 through (3) of this section, pro e following standards arc mct: <br />23 1. For lots cxcccding thc minimum lot dimcnsions of duplex lots, thc guest cottage <br />24 must bc located within thc smallest duplex sizcd lot that could bc created <br />25 including the principal ^'welling unit; <br />26 1. Where otherwise allowed by the underlying zoning district, an accessory dwelling <br />27 unit (ADU) A gucst cottage must not cover more than 700 square feet of land <br />28 surface and must not exceed 15 feet in height; and <br />29 2. An gucst cottage accessory dwelling unit must be located or designed to reduce <br />30 its visibility as viewed from public waters and adjacent shorelands by vegetation, <br />31 topography, increased setbacks or color, assuming summer leaf -on conditions. <br />32 d. Lots intended as controlled accesses to public waters or as recreation areas for use by <br />33 owners of nonriparian lots within subdivisions are permissible and must meet or exceed <br />34 the following standards: <br />35 1. They must meet the width and size requirements for residential lots, and be <br />36 suitable for the intended uses of controlled access lots; <br />37 2. If docking, mooring, or over -water storage of more than six watercraft is to be <br />38 allowed at a controlled access lot, then the width of the lot (keeping the same lot <br />39 depth) must be increased by the percent of the requirements for riparian <br />40 residential lots for each watercraft beyond six, consistent with the following <br />41 table: <br />1 <br />Controlled Access Lot Frontage Requirements <br />Page 135 of 160 <br />
