1 4. The roof may be used as a deck with safety rails, but must not be enclosed or used <br />2 as a storage area; <br />3 5. The structure or facility must not be designed or used for human habitation and <br />4 must not contain water supply or sewage treatment facilities; and <br />5 6. As an alternative for general development and recreational development <br />6 waterbodies, water -oriented accessory structures used solely for watercraft <br />7 storage, and including storage of related boating and water -oriented sporting <br />8 equipment, may occupy an area up to 400 square feet provided the maximum <br />9 width of the structure is 20 feet as measured parallel to the configuration of the <br />10 shoreline. <br />11 c. Stairways, lifts, and landings. Stairways and lifts are the preferred alternative to major <br />12 topographic alterations for achieving access up and down bluffs and steep slopes to <br />13 shore areas. Stairways and lifts must meet the following design requirements: <br />14 1. Stairways and lifts must not exceed four feet in width on residential lots. Wider <br />15 stairways may be used for commercial properties, public open -space recreational <br />16 properties, and planned unit developments; <br />17 2. Landings for stairways and lifts on residential lots must not exceed 32 square feet <br />18 in area. Landings larger than 32 square feet may be used for commercial <br />19 properties, public open -space recreational properties, and planned unit <br />20 developments; <br />21 3. Canopies or roofs are not allowed on stairways, lifts, or landings; <br />22 4. Stairways, lifts, and landings may be either constructed above the ground on <br />23 posts or pilings, or placed into the ground, provided they are designed and built <br />24 in a manner that ensures control of soil erosion; <br />25 5. Stairways, lifts, and landings must be located in the most visually inconspicuous <br />26 portions of lots, as viewed from the surface of the public water assuming summer, <br />27 leaf -on conditions, whenever practical; and <br />28 6. Facilities such as ramps, lifts, or mobility paths for physically handicapped persons <br />29 are also allowed for achieving access to shore areas, provided that the <br />30 dimensional and performance standards of the items in subsections (f)(2)c.1 to 5 <br />31 of this section are complied with in addition to the requirements of Minn. Rules <br />32 ch. 1340. <br />33 d. Significant historic sites. No structure may be placed on a significant historic site in a <br />34 manner that affects the values of the site unless adequate information about the site <br />35 has been removed and documented in a public repository. <br />36 e. Steep slopes. The city engineer must evaluate possible soil erosion impacts and <br />37 development visibility from public waters before issuing a permit for construction of <br />38 sewage treatment systems, roads, driveways, structures, or other improvements on <br />39 steep slopes. When determined necessary, conditions must be attached to issued <br />40 permits to prevent erosion and to preserve existing vegetation screening of structures, <br />41 vehicles, and other facilities as viewed from the surface of public waters, assuming <br />42 summer, leaf -on vegetation. <br />43 (3) Height of structures. All structures in residential districts, except churches and nonresidential <br />44 agricultural structures, must not exceed 35 feet in height. <br />45 (D) Shoreland alterations. Alterations of vegetation and topography will be regulated to prevent erosion <br />46 into public waters, fix nutrients, preserve shoreland aesthetics, preserve historic values, prevent <br />47 bank slumping, and protect fish and wildlife habitat. <br />48 (1) Vegetation alterations. <br />Page 138 of 160 <br />
