1 as product brands and prices, must not be located higher than ten <br />2 feet above the ground, and must not exceed 32 square feet in size. If <br />3 illuminated by artificial lights, the lights must be shielded or directed <br />4 to prevent illumination out across public waters; and <br />5 C. Other outside lighting may be located within the shore impact zone <br />6 or over public waters if it is used primarily to illuminate potential <br />7 safety hazards and is shielded or otherwise directed to prevent direct <br />8 illumination out across public waters. This does not preclude use of <br />9 navigational lights. <br />10 2. Uses without water -oriented needs must be located on lots or parcels without <br />11 public waters frontage, or, if located on lots or parcels with public waters <br />12 frontage, must either be set back double the normal ordinary high water level <br />13 setback or be substantially screened from view from the water by vegetation or <br />14 topography, assuming summer, leaf -on conditions. <br />15 h. Agriculture use standards. <br />16 1. General cultivation farming, grazing, nurseries, horticulture, truck farming, sod <br />17 farming, and wild crop harvesting are permitted uses if steep slopes and shore <br />18 and bluff impact zones are maintained in permanent vegetation or operated <br />19 under an approved conservation plan (Resource Management Systems) <br />20 consistent with the field office technical guides of the local soil and water <br />21 conservation districts or the United States Soil Conservation Service, as provided <br />22 by a qualified individual or agency. The shore impact zone for parcels with <br />23 permitted agricultural land uses is equal to a line parallel to and 50 feet from the <br />24 ordinary high water level. <br />25 2. Animal feedlots must meet the following standards: are not permitted in the <br />26 Shoreland Overlay. <br />27 New feedlots must not be located in thc she -eland of watercourses or in <br />28 bluff impact zones and must meot a minimum setback of 300 fcct from the <br />29 edinary high water level of all public waters basins; and <br />30 Modifications or expansions te-existingts that arc located within 39O <br />31 fcct of thc ordinary high water level or within a bl-uff impact zone are <br />32 allowed if they do not further encroach into the existing-efdinary- h, <br />33 water level setback or encroach on bluff impact zones. <br />34 c. Forest management standards. The harvesting of timber and associated reforestation <br />35 must be conducted consistent with the provisions of the Minnesota Nonpoint Source <br />36 Pollution Assessment -Forestry and the provisions of Water Quality in Forest <br />37 Management "Best Management Practices in Minnesota." <br />38 d. Extractive use standards. <br />39 1. Site development and restoration plan. An extractive use site development and <br />40 restoration plan must be developed, approved, and followed over the course of <br />41 operation of the site. The plan must address dust, noise, possible pollutant <br />42 discharges, hours and duration of operation, and anticipated vegetation and <br />43 topographic alterations. It must also identify actions to be taken during <br />44 operation to mitigate adverse environmental impacts, particularly erosion, and <br />45 must clearly explain how the site will be rehabilitated after extractive activities <br />46 end. <br />47 2. Setbacks for processing machinery. Processing machinery must be located <br />48 consistent with setback standards for structures from ordinary high water levels <br />49 of public waters and from bluffs. <br />Page 142 of 160 <br />
