1 (D) Compliance. The use of any land within the Scenic River Land Use District; the size and shape of lots; <br />2 the use and location of structures on lots; the installation and maintenance of water supply and <br />3 waste disposal facilities; the filling, grading, lagooning, or dredging of any river area; the cutting of <br />4 vegetation or alteration of the natural topography within the district; and the subdivision of land <br />5 shall be in full compliance with the terms of this subdivision and other applicable regulations. <br />6 Permits from the zoning authority are required by this Code, for the construction of buildings, public <br />7 or private water supply and sewage treatment systems, the grading and filling of the natural <br />8 topography, and erection of signs within the Scenic River Land Use District of the Rum River. <br />9 <br />10 952 District Application <br />11 (A) The Scenic River Land Use District of the Rum River, within the city, is divided into two areas: The <br />12 portion of thc Sccnic Rivcr Land Use District locatcd within the along the line between the North <br />13 and South half of Section 19, Township 32, Range 24. e-f this chaptef South of that line shall be <br />14 classified as an urban district arca; and thc rcmaindcr of thc Sccnic River Land Usc District within <br />15 thc city north of that line shall be classified as a rural district arca. <br />16 (B) The Scenic River Land Use District shall be shown on the official zoning map, as shall the urban and <br />17 rural area portions of the district contained therein. <br />18 (C) The provisions of Minn. Rules pts. 6105.0010-6105.0250 shall apply within the Scenic River Land <br />19 Use District, as specified in the Minn. Rules pts. 6105.1400-6105.1500. Where the provisions of <br />20 this Code are in conflict with Minn. Rules pts. 6105.1400-6105.1500, the provisions of Minn. Rules <br />21 pts. 6105.1400-6105.1500 shall apply. Copies of Minn. Rules pts. 6105.0010-6105.0250 and <br />22 6105.1400-6105.1500 shall be kept on file in the office of the administrator. <br />23 <br />24 953 Scenic River Protection Overlay District Uses <br />25 Urban area. The urban area of the scenic River Land Use District is designated the Urban Area <br />26 Overlay District. <br />27 (1) Permitted uses are all permitted uses allowed and regulated by the applicable zoning district <br />28 underlying the urban area overlay district, as indicated on the official zoning map of the city, <br />29 except that public roads, utility crossings, and all private and commercial recreation uses shall <br />30 be conditional uses. <br />31 (2) Conditional uses are all conditional uses and applicable attached conditions allowed and <br />32 regulated by the applicable zoning district underlying the urban area overlay district, as <br />33 indicated on the official zoning map of the city. <br />34 (B) Rural areas. The uses allowed within the rural area of the Rum River Scenic Land Use District shall <br />35 be those prescribed for a Scenic River Minn. Rules pt. 6105.0100 as follows: <br />Scenic River <br />(1) Governmental campgrounds, subject to management plan specifications and the P* <br />provisions of section 117-261(g). * <br />(2) Private campgrounds, subject to management plan specifications and the provisions of C** <br />section 959(G). <br />(3) Public accesses, road access type with boat launching facilities subject to management P <br />plan specifications and the provisions of section 959(G). <br />(4) Public accesses, trail access type, subject to management plan specifications and the P <br />provisions of section 959(G). <br />(5) Temporary docks. C <br />(6) Other governmental open space recreational uses, subject to management plan P <br />specifications and the provisions of section 117-261(g). <br />Page 151 of 160 <br />
