1 stone, sand, and gravel. Nonmetallic mining does not include ancillary facilities such as access roads,
<br />2 bridges, culverts, and water level control structures. For purposes of this subpart, "facility" includes
<br />3 all mine pits, quarries, stockpiles, basins, processing structures and equipment, and any structures
<br />4 that drain or divert public waters to allow mining.
<br />5 Obstruction means any dam, wall, wharf, embankment, levee, dike, pile, abutment, projection,
<br />6 excavation, channel modification, culvert, building, wire, fence, stockpile, refuse, fill, structure, or
<br />7 matter in, along, across, or projecting into any channel, watercourse, or regulatory floodplain which
<br />8 may impede, retard, or change the direction of the flow of water, either in itself or by catching or
<br />9 collecting debris carried by such water.
<br />10 Off -premise advertising signs. Those signs that direct attention to a product, service, business, or
<br />11 entertainment venue that is not exclusively related to the premises where the sign is located.
<br />12 Off-street loading space means a space accessible from the street, alley or way, in a building or on the lot
<br />13 for the use of trucks while loading or unloading merchandise or materials. Such space shall be of
<br />14 such size as to accommodate one truck of the type typically used in the particular business and shall
<br />15 be exclusive of general public and employee parking spaces.
<br />16 On site means any location within the boundaries of a site.
<br />17 One hundred -year floodplain means lands inundated by the regional flood.
<br />18 Open space means an area set aside for the preservation of natural open spaces to counteract the effects
<br />19 of urban congestion and monotony.
<br />20 Open space recreation uses means recreation use particularly oriented to and utilizing the outdoor
<br />21 character of any area; including hiking and riding trails, primitive campsites, campgrounds,
<br />22 waysides, parks and recreational areas.
<br />23 Operable motor vehicle means a vehicle that can be presented in a self-propelled condition within seven
<br />24 days of the city's request for such action.
<br />25 Ordinary high water level (OHWL) (MRCCA). Having the meaning given under Minn. Stats. § 103G.005.
<br />26 Ordinary high water mark means either of thc following:
<br />27 {1) The boundary of public waters and -wetlands, and shall be an elevation delineating thc highcst
<br />28 water level which has been maintained for a sufficient period of time to Ic ve evidence upeff
<br />29 the landscape, comrn-e+-l-y that point whcrc the natural vegetation changes from
<br />30 predominantly aquatic to pre4ominantly terrestrial. For watercourses, the ordinary high
<br />31 water level is the elevation of thc top of the bank of thc channel. For reservoirs and flowagcs,
<br />32 thc ordinary high water level is the oper^ ^ " ^f +�,-c normal summer pool.
<br />33 {2) Generally thc boundary elevation where thc vcgctatie+i--changes from predominately aquatie
<br />34 (where "aquatic" broadly means that the vegetation can surviv-e moist conditions) to
<br />35 terrestrial. This elevation delineates thc highcst water level, which has been maintained for
<br />36 a sufficient period of time to leave evidence upon thc landscape, comma -may that point whcrc
<br />37 the natural \tegctatian—changeom pred-ominantly aquatic to pre-d-e+ inantly terrestrial.
<br />38 Water often reaches this elevation in spring. For rivers and steams the ordinary high water
<br />39 mark is usually the top of the bank. It is less well dcfincd for lakes and-w-ctlands. The- e-finitieff
<br />40 in Minn. State. § 103G.005, subd. 14 provides that thc "... "Ofdinary high water level" means
<br />41 the boundary of water basins, watercourses, public water, and public waters wetlands, and
<br />42 a. The ordinary high water level is an elevation delineating thc highest water level that
<br />43 has been n^Tui-Ar or a suff+E+cnt period of time to leave evidence upon the
<br />44 landscape, comma-F4y thc point where thc natural vegetation changes from
<br />45 predominantly aquatic to predominantly terrestrial;
<br />46 b. For watercourses, the ordinary high water level is the elevation of thc top of the bank

<br />48 •c. For reservoirs and flowage, the ordinary high water level is the-e-perating el-evati-o-n of
