Ida:ardour and or- nui ancc trcc 17 Thc city shall have the right to-causc thc rcmoval of any dcad or diseased trccs on private property within 18 thc city, whcn such trccs constitute a hazard to life or property, or harbor insccts or discasc which 19 eonstitutc a potential threat to othcr trccs within the-ei-ty. In thc event of failurc of owncrs te-eomply with 20 Bch provision, the-ei-y shall have thc authority to rcmovc such trees and-chargc thc cost of rcmoval to 21 thc property owncr. 22 {1) Notice to take action. An ordcr for a "Notice to Takc Action" will bc issued upon detcrminatief 23 by thc city, or its designee, that maintenance work requiring thc pruning, preservation, or 24 removal of trccs or plants upon private property whcn such act -Eon is necessary to enure 25 public safety and/or to prevent the sprcad of discasc or insects to public trees and places. 26 a. Such notice shall describe the kind of trcc, shrub, or othcr plant or plant part which has- 27 been declared to be a public nuisance; its location on thc property; and thc reason for 28-eclaring it a nuisanee 29 b. Proper disposal procedures of wood, bark and debris from said nuisanec shall be 30 retailed in said notice. Thcsc disposal procedures shall bc followed within thc time 31 provided in thc notice. 32 •c. Thc notice of violation shall state the specific violation and indicate whether immediate 33 enforcement will bc sought or if 30 days will bc allowed to correct and rcmovc thc 34 v+olatie 35 •d. If thc owncr of thc property to whom an efd-cr has been issued -fails or refuses to take 36 remedial act -Eon in accordance with and -within thc time specified in an ewer, the -city 37 or its dcsignatc shall causc the remedial act -Eon ordered to bc performed at the 38 expense of the owncr. Appeals shall bc in accordance with scction 117 55. 39 {2) Discasc or pest infested trccs. Any trcc located within thc city, which is determined by a 40 certified arborist to bc afflicted with any dangerous or infectious inject infestatie-n-or plant 41 disease, may be declared a pub-I+c nuisanec. This shall include trees and shrubs harboring 42 injurious insects or pathegcns that may-causc significant potential danger to thc community 43 forest. 44 a. Thc city or its dcsignatc may rcmovc or cauSc or ordcr to bc removed, any trcc or part 45 thereof which is in an unsafe condition or which by rc\mon of its nature is injurious to 46 sewers, electric powcr lincs, gay lincs, water lines, or othcr public improvcmcnts, or is 47 i nfcctcd with Oak Wilt or Dutch Elm Discasc.
