04/1~/2005 21:30 7634349599 CITY OF HAM LAKE PAGE <br /> <br /> CITY OF HAM LAKE <br />CHARTER COIVIMISSSION MEETING <br />AUGUST 16, 2004 <br /> <br />The Ham Lake Charter Commission met on Monday, August 16, 2004 at the Ham Lake <br />City Hall, 15544 Central Avenue NE. Members present were Susie Thomas, Sharon <br />Ayshford, John Weber, Susan Phill/ps and Allen Stanffacher. Gary Kirkeide and A1 <br />Sannerud were absent. <br /> <br />Acting Chair, Commissioner Weber called the meeting to order at 6:30 p.m. <br /> <br />Motion by Thomas, seconded by Phillips, to approve the minutes of the September <br />2, 2004 Charter Commission meeting. Al! present in favor, motion carried. <br /> <br />Motion by Thomas, secCnded by Stanffacher, to nominate and elei:t' John Weber az <br />Chair of the Charter Commission. All pre~ent in favor, motion carried. <br /> <br />Chair Weber asked if any Commissioners had further business to present. <br /> <br />Commissioner AYshford presented information to the Commission regarding new <br />legislation that had been passed by the State Legislature in 2004. Chapter 197 <br />(HF13'92/SF1334) allows for a city's charter to prohibit members of' the City Council <br />from serving on the Charter Commission. It also removes the term limitation for <br />commission members. This law amends Minn. Stat. 410.05. <br /> <br />The Commission discussed the information and inquired if they could make a <br />recommendation for the Council to consider even though, this item was not listed <br />separately on the agenda. Comm/ssioner Ayshford stated that a motie.n could be made, <br />but it would need to be discussed with the City's legal counsel. If necessary, the item <br />would be listed on the next Commission meeting agenda. <br /> <br />Motion' by Weber, seconded by l'hl!iips, to recommend to the City Council that an <br />amendment be made to the City Charter, Ikn/ting the number of seats on the <br />Charter Commission that can be filled by Councilmembers to less than the <br />majority. All present in favor, motion carded. <br /> <br />The Commission discussed whether this limitation should apply to other groups also, <br />such ag the Planning Commission, City staff, etc. Commission Chair Weber stated he <br />would leave his motion as it stands. <br /> <br />ComJ.~aissioner Ayshford stated that she would ltd'erin the Commissioners of the City <br />Attorney's opinion regarding the motion. <br /> <br />Motion by Thomas, seconded by Phtll:ips, to adjourn the Charter Commission <br />meeting at 6:42 p.mi All present in favor, motion carried. <br /> <br />Sharon Ayshford <br />Commissioner <br /> <br /> <br />
