Worksheet and it is over $6 million for transportation. We feel the best way to do the assessment
is the entire tract; however, under this language, they could petition and kill this process.

Attorney Goodrich stated that whatever language is talked about, we must make sure it's
constitutional.

Mr. Norman cautioned that the City could lose some good projects because of this.

Chairperson Vogt explained the process for Charter amendments.

Commissioner Fischer suggested that this language is something we would want to have ready in
a very short period of time.

Mr. Goodrich stated that we thought about amending it by ordinance - that's one of the ways to
amend the Charter. In that instance, the Charter Commission would recommend the ordinance to
the City Council. The City Council would have a public hearing and if the City Council passed
the ordinance unanimously, they would adopt the amendments, and 90 days after its publication,
the amendment would be effective.

Commissioner Ebel inquired if any developers have stated that they would be pulling out of
Ramsey because of this.

Mr. Norman replied no, but we have shared this discussion with them. We have heard about one
waiting for another to develop so the first would have to pay all the fees. Because of this Charter
meeting being scheduled, staff decided to discuss this now too.

Mr. Goodrich stated staff would work on language right away and that the Charter Commission
should meet again very soon.

Commissioner Deemer mentioned making some technical corrections.

Chairperson Vogt suggested moving forward with this and maybe Commissioner Deemer could
talk with Attorney Goodrich about the technical corrections.

Commissioner LaMere stated that Chapter 429 is about assessments based on benefits and
inquired if Chapter 444 is not based on benefit.

Attorney Goodrich responded that Chapter 444 is where we can set up an ordinance for hook up
fees and for storm water - that's a different process than showing benefit.

Commissioner LaMere stated that sewer and water are not the issue. Are there any other
specified statutes on transportation funding and costs.

Attorney Goodrich replied no - there is lots of discussion on transportation impact fees - they
are illegal in Minnesota.

Charter Commission - April 27i 2006
