7. 1. <br />CC Regular Session <br />Meeting Date: 09/12/2023 <br />PrimaryStrategic Plan Initiative: Create a positive image for residential neighborhoods, business districts and key <br />g corridors. <br />Information <br />Title: <br />Adopt Ordinance #23-16 Amendment to Chapter 16, Article XIV Rental Residential Dwelling Units <br />Purpose/Background: <br />At the August 22, 2023 City Council meeting, Ordinance #23-16 was introduced. The amendment to Chapter 26, <br />Article XIV. Rental Residential Dwelling Units updates the application requirements for rental licenses, <br />associated fees, inspection process, and creates a crime -free housing program, in which all rental properties will <br />be a part of. Changes will require an annual renewal of rental licenses and annual interior inspections of rental <br />units. The intent of the changes is to create a rental inspection program for the good of all residents in and around <br />rental properties that focuses not only on items described in the Crime -Free Housing Program, but that would <br />equally benefit all tenants and the respective property owners. <br />At the time of the ordinance introduction, there was a council suggestion to ensure a "current" state issued drivers <br />license or identification card is provided; therefore, in Section 26-646. Application a(8), the word "current" has <br />been added. <br />The draft Ordinance #231-16 is attached for your review. <br />Notification: <br />If the ordinance is adopted, rental license holders will be notified in September 2023 regarding the changes that <br />will be effective January 1, 2024. <br />Time Frame/Observations/Alternatives: <br />If the ordinance is adopted, it will be published for 30 days and will become effective on January 1, 2024. <br />City Council may consider the following options: <br />1. Motion to adopt or deny the ordinance as written <br />2. Motion to adopt or deny ordinance with modifications <br />Funding Source: <br />Annual rental license fees will be collected. Annual fees will be approved as part of the 2024 Rates and Fees <br />Schedule and will become effective January 1, 2024. The annual license fees collected will cover the costs of the <br />rental inspections program; including staff time of the rental housing inspector, police, fire, the purchase of an <br />inspection vehicle, miscellaneous equipment and all other associated fees. <br />Recommendation: <br />Staff recommends the adoption of Ordinance #23-16. <br />Outcome/Action: <br />
