<br />CONDITIONS <br /> <br />1. Per civil plans dated 7/17/2023 as revised 8/30/2023. <br /> <br />2. Per architectural plans revised 8/3/2023. <br /> <br />3. That the Applicant enter into a Development Agreement with the City as prescribed by <br />City Code pertaining to development fees and financial guarantees. <br /> <br />4. Final legal form approved by the City Attorney. <br /> <br />5. That separate building permit and sign permits are required. <br /> <br />6. That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Resolution. <br /> <br />7. That this Resolution shall automatically expire if the use is not initiated by September 12, <br />2024, or a valid building permit has been issued. <br /> <br />8. That the Lower Rum River Watershed Management Organization shall review the <br />proposed site plan and all conditions therein shall be met, including a storm water <br />maintenance agreement. <br /> <br />9. That development of any future buildings on the site or expansion of the parking lot shall <br />require a new Land Use Application or as required by City Code in effect at the time. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Howell, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Kuzma <br /> Councilmember Musgrove <br /> Councilmember Howell <br /> Councilmember Olson <br /> Councilmember Riley <br /> Councilmember Specht <br /> Councilmember Woestehoff <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br />and the following abstained: <br /> <br /> None <br /> <br />Resolution #23-175 <br />Page 2 of 3 <br /> <br /> <br />
