Councilman Sorteberg introduced the following resolution and moved for <br />its adoption: <br /> <br />RESOLUTION 80-46 <br /> <br />RESOLUTION DELETING STREET IMPROVEMENT SPECIAL ASSESSMENT ON THAT PARCEL <br />OF LAND AS DESCRIBED BELOW OWNED BY BERTHA MAE SMITH JOHNSON <br /> <br /> WHEREAS, the City Council of the City of Ramsey, Anoka County, <br />State of Minnesota have reviewed the request from Bertha ~ae Smith Johnson <br />who owns the following described parcel 89209 9000-8 unplatted Section 9 <br />Township 32 Range 25 (Southeast Quarter of Southeast Quarter of Section <br />9 Township 32 Range 25 (Ex #9300) (Ex #9310) (Ex #9320) (Ex #9330) (Ex #9340) <br />(Ex #9350) (Ex #9360) (Ex #9370) (Ex #9390) (Ex #9400) (Ex #9380) (Ex #9410)) <br />that it be deleted from the special assessment rolls of construction project <br />79-9 because it is an unbuildable lot due to the swampy condition of the <br />parcel of land. <br /> <br /> WHEREAS, the City Council of the City of Ramsey, Anoka Cotuaty, <br />State of Minnesota have requested that the City of Ramsey be granted a drain- <br />age easement through the above said property of Bertha Mae Smith Johnson. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, <br />MINNESOTA, as follows: <br /> <br /> 1) The City of Ramsey hereby designates the above described <br />parcel as an unbuildable parcel of land. <br /> <br /> 2) The City of Ramsey does hereby agree to delete the Street <br />improvement (bituminous surfacing) special assessments on the above described <br />parcel of land providing the above said owner provides the City with an ease- <br />ment for drainage and utility purposes on the above described parcel. <br /> <br /> 3) The City has agreed to delete $1,753.36 which represents <br />the total levied on the above said property. Inasmuch as the above said <br />party has paid the first years special assessment installment of $278.80 the <br />City Administrator is directed to refund it. Further, it is directed that <br />the balance of the above said special assessment in the amount of $1,632.38 <br />be deleted from the above described parcel of land. The above is to be ex- <br />ecuted upon receiving the drainage and utility easement as required above. <br /> <br /> 4) City A~nistrator is directed to furnish the City of <br />Ramsey Accounting office and the office of Comaty Auditor, Anoka County, <br />each a copy of this resolution. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded <br />by Councilman Cox and upon vote being taken thereon, the following voted <br />in favor thereof: <br /> <br />Mayor Gamec, Councilmen Sorteberg, Mickelson, Reimann <br />and Cox <br /> <br /> <br />
