Councilman Mickelson introduced the following resolution and moved for its <br />adoption: <br /> <br />RESOLUTION #80-65 <br /> <br /> WHEREAS, Mr. August Peltzer is the fee title owner of the <br />following described property in the City of Ramsey, to wit: <br /> <br />That part of the Southwest Quarter of the Southwest <br />Quarter of Section 22, Township 32, Range 25, Anoka <br />County, Minnesota described as follows: Commencing <br />at a point on the North line of said Southwest <br />Quarter of the Southwest Quarter distant 240.02 feet <br />East from the Northwest corner of said Southwest Quarter <br />of the Southwest Quarter; thence South and parallel with <br />the West line of said Southwest Quarter of the Southwest <br />Quarter a distance of 226.99 feet to the actual point of <br />beginning of the tract of land to be hereby described; <br />thence continue South on said parallel line a distance <br />of 300 feet; thence East on a line drawn at right angles <br />to the West line of said Southwest Quarter of the South- <br />west Quarter a distance of 283.96 feet; thence North and <br />parallel with the West line of said Southwest Quarter of <br />the Southwest Quarter a distance of 288.61 feet, more or <br />less, to a point distant 234.82 feet South from the North <br />line of said Southwest Quarter of the Southwest Quarter <br />as measured along said parallel line; thence Westerly a <br />distance of 284.18 feet to the actual point of beginning. <br />Subject to easement for road purposes over the East 66 <br />feet thereof. <br /> <br />and <br /> <br /> WHEREAS, the fee owner has applied to the City Council for a <br />variance from the City's Subdivision Code such that he may be permitted to <br />subdivide the above described parcel into two separate parcels by metes and <br />bounds legal descriptions; and <br /> <br /> WHEREAS, the City Council finds that an undue hardship will <br />exist if this subdivision is not permitted; and <br /> <br /> WHEREAS, the Comacil finds that previous City Councils in dis- <br />cussions with Mr. Peltzer agreed to permit this variance; and <br /> <br /> WHEREAS, the granting of this variance does not adversely <br />affect the spirit and intent of the City's subdivision regulations and street <br />frontage requirements. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> 1) That the property legally described above may be subdivided <br />by metes and bounds into two separate parcels, which parcels shall have <br />separate legal descriptions as follows: <br /> <br /> <br />
