Councilman Sorteberg introduced the following resolution and moved for its adoption: RESOLUTION #80-119 WHEREAS, Coumty Ditch #43 traverses through the City of Ramsey on property which is where the proposed plat of Flintwood Hills Second Addition is to be located, and WHEREAS, said County Ditch #43 is in a current state of dis- repair and apparently not functioning, and WHEREAS, even though said ditch is not functioning the City finds it is in the best interests of the community to continue the original function of County Ditch #43, and WHEREAS, the developer of Flintwood Hills Second Addition has requested that the City of Ramsey agree with said developers petition for partial abandonment of County Ditch #43 and setting out certain properties from said drainage system, which petition will be presented to the Anoka County Board of Commissioners. NOW THEREFORE, THE RAMSEY CITY COUNCIL HEREBY RESOLVES, as follows: 1) To approve the partial abandonment of the present alig~nent of Ditch #43 as proposed by the developers petition and to so advise the Anoka County Board of Commissioners of this action. 2) To approve the relocation of Ditch #43 as proposed by the developers in its petition. 3) To enter into an agreement with the developer for installation of the relocated ditch in areas of the proposed plat not served by the storm water system in order to maintain the continuity of Ditch #43. 4) That in order to maintain the continuity of Ditch #43~ require a storm water system including piping large enough to serve this specific plat as required by the existing City Code. The motion for the adoption of the foregoing resolution was duly seconded by Councilman Mickelson and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec, Councilmen Sorteberg, L~ckelson, Reimar~n and Cox and the following voted against the same: None whereupon said resolution was declared duly passed and adopted by the Rsmsey City Council this the 23rd day of September, 1980.
