Councilman Cox introduced the following resolution and moved for its <br />adoption: <br /> <br />RESOLUTION #80-146c <br /> <br />RESOLUTION AUT~ORIZINQ T~E DELETION OF ASSESagNT; CASE OF BErNArD STEINLm <br />LOT 1 BLOCK 5 RIVERWOOD HILLS PLAT #1 (CONSTRUCTION PROJECT #80-14 STREET <br />I~ROVm~T) <br /> <br /> WHEREAS, Mr. Bernard Steinlag stated at the public hearing <br />dated October 15, 1980, which was held to levy the special assessment to <br />Public Improvement (Bituminous surfacing of street) Project #80-14 did not <br />benefit on Lot 1 Block 5 Riverwood Hills Plat #1 due to the fact that the <br />above parcel of land is unbuildable; and <br /> <br /> WHEREAS, the City Comncil, City of Ramsey, Anoka County, State <br />of Minnesota, did at its regular meeting direct City Staff to prepare a find- <br />ing of fact regarding the buildability of the above named parcel of land <br />owned by Mr. Bernard Steinlag; and <br /> <br /> WHEREAS, City Staff submitted a finding of fact to the City <br />Council on the above case as requested by the City of Ramsey. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> 1) The Ramsey City Council has reviewed said findings of fact <br />and have directed the following action: <br /> <br />a) <br /> <br />That the City of Ramsey adopt the finding of fact as <br />presented with no modification to it that Lot 1 Block 5 <br />Riverwood Hills Plat #1 is not a buildable parcel of <br />land. <br /> <br />b) <br /> <br />That the City of Ramsey delete the special assessment <br />against Lot 1 Block 5 Riverwood Hills Plat #1 for the <br />public improvement (Street bituminous surfacing) <br />Project #80-14 in the amount of $1,538.85. <br /> <br />c) That the above deleted assessment will become the City <br /> share. <br /> <br /> 2) It is further directed that this parcel be recorded as an <br />unbuildable lot based on the adopted findings of fact this date at the <br />Register of Deed's office. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded <br />by Councilman Reimann and upon vote being taken thereon, the following <br />voted in favor thereof: <br /> <br />Mayor Gamec, Councilmen Sorteberg, Mickelson, Reimann and Cox <br /> <br /> <br />
