Councilman Cox introduced the following resolution and moved for its adoption: RESOLUTION #80-146c RESOLUTION AUT~ORIZINQ T~E DELETION OF ASSESagNT; CASE OF BErNArD STEINLm LOT 1 BLOCK 5 RIVERWOOD HILLS PLAT #1 (CONSTRUCTION PROJECT #80-14 STREET I~ROVm~T) WHEREAS, Mr. Bernard Steinlag stated at the public hearing dated October 15, 1980, which was held to levy the special assessment to Public Improvement (Bituminous surfacing of street) Project #80-14 did not benefit on Lot 1 Block 5 Riverwood Hills Plat #1 due to the fact that the above parcel of land is unbuildable; and WHEREAS, the City Comncil, City of Ramsey, Anoka County, State of Minnesota, did at its regular meeting direct City Staff to prepare a find- ing of fact regarding the buildability of the above named parcel of land owned by Mr. Bernard Steinlag; and WHEREAS, City Staff submitted a finding of fact to the City Council on the above case as requested by the City of Ramsey. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) The Ramsey City Council has reviewed said findings of fact and have directed the following action: a) That the City of Ramsey adopt the finding of fact as presented with no modification to it that Lot 1 Block 5 Riverwood Hills Plat #1 is not a buildable parcel of land. b) That the City of Ramsey delete the special assessment against Lot 1 Block 5 Riverwood Hills Plat #1 for the public improvement (Street bituminous surfacing) Project #80-14 in the amount of $1,538.85. c) That the above deleted assessment will become the City share. 2) It is further directed that this parcel be recorded as an unbuildable lot based on the adopted findings of fact this date at the Register of Deed's office. The motion for the adoption of the foregoing resolution was duly seconded by Councilman Reimann and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec, Councilmen Sorteberg, Mickelson, Reimann and Cox
