Councilman Mickelson introduced the following resolution and moved for its adoption: RESOLUTION #80-148 RESOLUTION AUTHORIZING DELETION OF ASSESS~NT; CASE OF MRS. DOROTHY J. SMITH, 6820 - 158TH AVENUE N.W. (PLAT 89215 PARCEL 6645 00NSTRUCTION PROJECT #80-10) WHEREAS, Mrs, Dorothy J. Smith stated to the City Engineer she did not want the City of Ramsey using her land, Plat 89215 Parcel 6645, as a drainage area for 158th Avenue N.W. without having a proper drainage easement; and WHEREAS, the City Attorney informed the City Council, City of Ramsey, that the City was required to acqu/re a drainage easement if the City wanted to drain water from the street onto her property; and WHEREAS, the City Engineer, Mr. Peter Raatikka presented a proposed 20 foot wide drainage easement swale that the City would construct through her property; and WHEREAS, the City Engineer, Mr. Peter Raatikka of Consulting Engineers Diversified, Inc., stated that the City wo~d need a drainage ease- ment 20 feet wide running approximately 450 feet across ~.~s. Dorothy J. Smith property Plat 89215 Parcel 6645. The City would have to construct a drainage swale on the above proposed easement which would be approximately 160 feet in length from the street to the dirt berm on Mrs. Smith property~ and WHEREAS, the City Attorney stated Mrs. Dorothy J. Smith would accept $950.00 deleted from her assessment on Plat 89215 Parcel 6645 for granting the City the proposed above easement. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) The City Council directed the City Attorney and City En- gineer to prepare the above proposed easement across Mrs. Dorothy J. Smith property Plat 89215 Parcel 6645 and to have ~%s. Smith sign said documents. 2) The City Council agreed to delete $950 from the street im- provement (bituminous surfacing) special assessment which is $1,996.43 and leaves a balance of $1,046.43 to be assessed against parcel 6645 plat 89215. 3) The City Council directed that Mrs. Dorothy J. Smith be furnished a copy of this resolution. 4) The City Comacil further directs that the City Administrator has the subject easement recorded at the Court House and further directs that a copy of this resolution be furnished to the City Accounting Department.
