3) That the parties hereto shall execute a recordable agree- <br />ment with the City of Ramsey providing that only one building permit will <br />be issued on the entire parcel, and that said 40 acre parcel will not be <br />subdivided until the 66 foot wide parcel is dedicated and accepted by <br />the City as a public street, and finally the agreement shall provide a <br />waiver by the parties and their heirs and assigns whereby the parties <br />waive any and all claims and causes of action they may have against %he <br />City of Ramsey for failure of emergency equipment to reach the residence <br />to be constructed on the 40 acre tract~ the reason for this being that <br />the 40 acre tract is served by a 1320 foot private driveway which %he <br />City has no responsibility to maintain. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded <br />by Councilmember Cox and upon vote being taken thereon, the following <br />voted in favor thereof: <br /> <br />Mayor Gamec, Coancilmen Sorteberg, Vs~ Wagner, Reimar~n and <br />Cox <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />whereupon said resolution was declared duly passed and adopted by the <br />Ramsey City Council this the 14th day of April, 1981. <br /> <br />Mayor <br /> <br />~at~r/C <br /> <br /> <br />
