Councilman Cox introduced the following resolution and moved for its <br />adopt ion: <br /> <br />RESOLUTION #81-47 <br /> <br /> WHEREAS, August Peltzer, Jr. and Pearl Peltzer, husband <br />and wife, are the fee title owners of the following legally described <br />property in the City of Ramsey: <br /> <br />The North 200 feet of the South 594.37 feet of the <br />West 524 feet of the Southwest Quarter of Southwest <br />Quarter of Section 22, Township 32, Range 25, A~oka <br />County, Minnesota, as measured along the South and <br />West lines of said Southwest Quarter of the South- <br />west Quarter. Subject to road easement over the <br />east 66 feet thereof and the West 60 feet thereof. <br /> <br /> WHEREAS, in 1977 the Ramsey City Council passed a resolution <br />regarding the metes and bounds subdivision of said parcel, the meaning of <br />which resolution is somewhat ambigious; and <br /> <br /> WHEREAS, the Ramsey City Council mow finds that it did in- <br />deed intend to permit the metes and bounds subdivision of the above des- <br />cribed property into two parcels in 1977 and does find that an undue hard- <br />ship will exist if this subdivision is not permitted and that this vari- <br />ance does not adversely affect the spirit and intent of the City's sub- <br />division regulations; and <br /> <br /> WHEREAS, all the other parcels adjacent to the Northwest <br />parcel, as Parcel A described below, has a 161.37 foot frontage on <br />County Road #56 and a variance to allow a building permit to be granted <br />on this parcel notwithstanding that it did not have the then required <br />200' public road frontage was granted by the City Council on March 14, <br />1977 and subject parcels have been previously granted a variance to sub- <br />divide by metes and bounds as the metes and bounds subdivision im which <br />this parcel is included was stated prior to April, 1972; and <br /> <br /> WHEREAS, the subject parcel has been conveyed as two separate <br />parcels by a contract for deed dated August 1, 1974; and <br /> <br /> WHEREAS, the park dedication requirement has been previously <br />satisfied for this subdivision. <br /> <br />NOW THEREFORE, THE RAMSEY CITY COUNCIL RESOL~-ES AS FOLLOWS: <br /> <br /> 1) That the property described in paragraph one above may <br /> be subdivided by metes and bounds into two (2) separate <br /> parcels legally described as follows: <br /> <br /> <br />
