Councilmember Van Wagner introduced the following resolution and moved <br />for its adopt ion: <br /> <br />RESOLUTION #81- 127 <br /> <br /> WNEREAS, the developer of the plat known as Pondva!e has applied <br />to the City Council for a variance from the City subdivision chapter of the <br />Code, which chapter requires that before building permits may be issued, the <br />streets in the plat must be paved with concrete on bituminous surfacing or <br />adequate escrow provided to insure that the paving is completed, which sec- <br />tion # is 170.039I(2), and <br /> <br /> WHEREAS, the developer has indicated because of the current econ- <br />omic conditions and his own personal financial condition, he is unable to <br />pave the streets or provide the escrow, and <br /> <br /> WHEREAS, the developer has represented that if he can obtain a <br />building permit, and sell a lot, this will assist him in getting the paving <br />completed. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That Section 170.039I(2) of the City Code is hereby waived as to <br />PONDVALE plat so as to allow one building permit to be issued <br />prior to paving the streets in said plat and/or providing an escrow <br />to insure that the paving is completed. <br /> <br />2) <br /> <br />3) <br /> <br />That not ~ithstanding paragraph 2 above, no building permit may be <br />issued until the streets have been brought to Class V City standards. <br /> <br />That no occupancy permit shall be issued for the residence constructed <br />pursuant to the building permit issued by this motion until the streets <br />have been fully paved in accordance with Section 170.039I(2). <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Councilmember Sorteberg and upon vote being taken thereon, the following voted <br />in favor thereof: <br /> <br />Mayor Gamec, Councilmembers Van Wagner, Sorteberg, Reimann and Cox <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey <br />City Council this the 8~h day of September, 1981. <br /> <br />Mayor <br /> <br /> <br />
