Councilmember Sorteberg introduced the motion to adopt the following find- ings of fact regarding Mr. and Mrs. Scott Gulden's request to delete their parcel at 17645 Baugh STreet N.W. from the assessment roll of project #80-15. 1) The City Council September 4, 1980, ordered a public hearing because of interest shown for street improvements in an adjoining area. 2) A notice of public hearing was placed in the City's official paper and individua! notices were mailed to all affected residents. 3) The public hearing was held September 16, 1980, input was received from nnmerous residents, ttowever, Mr. Gulden's name did not appear in the minutes as having had any input. 4) On September 16, 1980, the City Council adopted resolution number 80-112 ordering the improvement. 5) On October 20, 1980, the City Council adopted resolution number 80-144 accepting the bid of N.D.H., INc. for the proposed construction. 6) On July 28, 1981, the City Coucil adopted resolution #81-93 ordering a public hearing be held on September 8, 1981, for the purpose of determining costs and the proposed assessments. 7) On September 8, 1981, the City Council held the public hearing and adopted resolution #81-128 establishing assessment costs. 8) The assessment policy for all projects was to divide total buildable parcels of land into the total cost to detemrine a unit assessment. 9) In unplatted areas where parcels exceeded the City lot size requirement, additional units were added accordingly to share in the project costs. 10) In this area Mr. Gulden's parcel contains 703.53 feet of frontage along 176th Avenue N.W. and over 5 acres including roadways; therefore, it was proposed for two assessments. 11) Using the City's criteria for determining a parcels suitability for building, there were several parcels that were not assessed. The undeveloped portion of this. property is suitable for building. 12) The City of Ramsey's criteria for determining a parcels buildability are: a) Adequate areas for the placement of and proper construction of an on-site septic system. b) Positive parcel drainage to deliminate flooding potentials under all conditions. 13) On September 8, 1981, Mr. Golden appeared before the City Council re- questing the deletion of this assessment.
