Councilmcmbcr Van Wagner introduced the motion to adopt the following <br />Findings of Fact regarding Mr. James Provinzino's request to declare Parcel <br />1590 unbenefited by Improvement Project #80-17 and dropped from the assess- <br />ment roll: <br /> <br />1) Tile City Council July 22, 1980, ordered a public hearing because of in- <br />terest shown for street improvements in an adjoining area. <br /> <br />2) A notice of public hearing was placed in the City's official paper and <br />individual notices were mailed to all affected residents. <br /> <br />3) The public bearing was held September 23, 1980, input was received from <br />numerous residents. However, Mr. Provinzino's name did not appear in the <br />m~nutes as }laving had any input. <br /> <br />4) On September 30, 1980, the City Council adopted REsolution #80-121 order- <br />ing the ~mprovement. <br /> <br />5) On October 14, 1980, the City Council adopted Resolution #80-133 accept- <br />~ng the bid of N.D.H., Inc. for the proposed construction. <br /> <br />6) On July 28, 1981, the City Council adopted Resolution #81-98 ordering <br />a public bearing be held September 8, 1981 for the purpose of determining <br />costs and the proposed assessments. <br /> <br />7) On September 8, 1981, the City Council held the public hearing. <br /> <br />8) On August 18, 1981, the City Council passed a motion to assess Project <br />#80-17 Tungsten Street Overlay at a unit cost of $200 for those units which <br />have access on Rivlyn Avenue and Front Street and assess the remainder of <br />the project on a front foot basis for those units adjacent to Tungsten <br />Street. <br /> <br />9) Based on the half section maps Mr. Provinzino's lot has approximately <br />100 feet of access on Front Street and was proposed to be assessed for <br />one unit. <br /> <br />10) On September 8, 1981, Mr. Provinzino appeared before the City Council <br />requesting teh deletion of this assessment, because Front Street has not <br />been constructed along his property. <br /> <br />11) On September 14, 1981, the parcel was reviewed by the City Engineer <br />and the Building Official, and Front Street was not found to be constructed <br />up to Mr. Provinzino's lot nor did it provide access to the property. <br /> <br />12) Based on a staff recommendation the Council ordered the preparation <br />of Findings of FAct for their reviewal at their next regular meeting of <br />September 22, 1981. <br /> <br />The motion for the adoption of the foregoing Findings of Fact were duly <br />seconded by Councilmember Cox and upon vote being taken thereon, the follow- <br />ing voted in favor thereof: <br /> <br />Mayor Gamec, Councilmembers Van Wagner, Sorteberg, Reimann and <br />Cox <br /> <br /> <br />
