Councilmember Van Wagner introduced the following resolution and moved for <br />its adoption: <br /> <br />RESOLUTION #81-163 <br /> <br />RESOLUTION TO DELETE SPECIAL ASSESSMENT REGARDING STREET IMPROVEMENT <br />PROJECT #80-15; CASE OF MR. LAWRENCE J. FERBER, 17501BAUGH STREET N.W. <br />(PLAT 89870 PARCEL 6500) <br /> <br /> WHEREAS, Mr. Lawrence J. Ferber stated at the public hearing on <br />September 8, 1981, which was held to adopt the special assessments for Public <br />Improvement Project #80-15 (bituminous surfacing of streets) that he should <br />not be assessed, as he did not receive a benefit from it; and <br /> <br /> WHEREAS, the City Council, City of Ramsey, Anoka County, State of <br />Minnesota directed City Staff to investigate the legality of assessing Plat <br />89870 Parcel. 6500 for the above street improvement; and <br /> <br /> WHEREAS, the Building Official did submit a memo to the City Admini- <br />strator dated September 15, 1981 stating that the above parcel of land is a <br />corner lot and that Mr. Ferber does not have a driveway to 176th Avenue which <br />falls within the purview of City Ordinance #80-8. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> 1) That the one (1) unit special assessment in the amount of <br />$1,593.77 levied against Plat 89870 Parcel 6500 be changed to one-half (~) <br />unit special assessment in the amount of $796.88 by reason of Section 210.015 <br />of the City Ordinance #80-8. <br /> <br /> 2) That the abve deleted one-half (~) unit special assessment in <br />the amount of $796.88 will become the City's share of costs. <br /> <br /> 3) It is further directed that the following administrative <br />action be accomplished on this case: <br /> <br />a) That the City Accountant be furnished a copy of this <br />resolution so that appropriate action may be taken in the <br />accounting and assessment records. <br /> <br />b) That a copy of this resolution be filed in Improvement <br />Project #80-15's file. <br /> <br />c) That Mr. Lawrence J. Ferber, 17501Baugh Street be fur- <br />nished a copy of this Resolution #81-163. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded <br />by Councilmember Reimann and upon vote being taken thereon, the following <br />voted in favor thereof: <br /> <br />Mayor Gamec, Councilmembers Van Wagner, Sorteberg, Reimann and <br />Cox <br /> <br /> <br />
