Councilmember Cox introduced the following resolution and moved for its <br />adoption: <br /> <br />RESOLUTION #81-164 <br /> <br />RESOLUTION REGARDING DRAINAGE EROSION; CASE OF COLLEEN JOHNSON, 7440 - <br />151ST LANE N.W. AND MICHAEL SCHUTZ, 7410 - 151ST LANE N.W. <br /> <br /> WHEREAS, Colleen Johnson who resides at 7440 - 151st Lane N.W. <br />is concerned about the new culvert that was put in as part of Street Im- <br />provement Project #81-4 to solve the drainage problem on the opposite side <br />of the street. She states concern that the angle of the culvert will cause <br />erosion to her property and flooding of it; and <br /> <br /> WHEREAS, Michael Schutz, 7410 - 151st Lane N.W. has stated <br />basically the same as the party above; and <br /> <br /> WHEREAS, the City Engineer, Consulting Engineers Diversified, <br />Inc., states that the culvert is used to resolve a drainage problem and <br />through proper construction and maintenance, will not cause property dam- <br />age to the above property owner. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> 1) That the City will be responsible for maintenance of the <br />storm drainage system. <br /> <br /> 2) That the City of Ramsey will repair any erosion of the above <br />named parties' land at no cost to them. <br /> <br /> 3) The restoration will be done as soon as possible if erosion <br />should ever occur to their property. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded <br />by Councilmember Van Wagner and upon vote being taken thereon, the follow- <br />ing voted in favor thereof: <br /> <br />Mayor Gamec, Councilmembers Van Wagner, Sorteberg, Reimann and <br />Cox <br /> <br />and the following voted against the same: <br /> <br />Nonc <br /> <br />whereupon said resolution was declared duly passed and adopted by the <br />Ramsey City Council this the 13th day of October, 1981. <br /> <br />lerk v ~~ <br /> <br /> <br />
