Councilmember Reimann introduced the motion to adopt the following Find- <br />ings of Fact regarding Mr. Ralph Nissen's request to declare Plat 89207 <br />Parcel 4250 unbuildable and dropped from the assessment role-of Project <br />#81-19: <br /> <br />l) The City Council, on June 23, 1981, ordered a public hearing because <br />of interest shown for street improvements in an adjoining area. <br /> <br />2) A notaice of public hearing was placed on the City's official paper <br />and individual notices were mailed to all affected residents. <br /> <br />3) The public hearing was held on July 28, 1981 and input was received <br />from numerous residents. However, Mr. Nissen's name did not appear in <br />the minutes as having had any input. <br /> <br />4) On July 28, 1981, the City Council adopted Resolution #81-109 order- <br />the improvement. <br /> <br />5) On September 8, 1981, the City Council adopted resolution #81--130 <br />accepting the bid of N.D.H., Inc. for the proposed construction. <br /> <br />6) On September 22, 1981, the City Council adopted Resolution #81-158 <br />ordering a public hearing be held October 14, 1981 for the purpose of <br />determining costs and the proposed assessments. <br /> <br />7) On October 14, 1981, the City Council held the public hearing and <br />adopted Resolution #81-171 establishing assessment costs. <br /> <br />8) On October 14~ 1981, Mr. Ralph Nissen appeared at the assessment <br />hearing to protest the fact he was being assessed for two units. <br /> <br />9) The assessment policy for all projects was to divide total buildable <br />parcels of land into the total cost to determine a unit assessment. <br /> <br />10) In unplatted areas where parcels exceed the City lot size requirement~ <br />additional units are added accordingly to share in the project costs. <br /> <br />11) This property is a. separate parcel and is a lot of record. <br /> <br />1.2) The City of Ramsey's criteria for determining a parcel's buildability <br /> <br />a) Adequate areas for the placement of and proper construction <br />of an on-site spetic system. <br /> <br />b) Positive parcel drainage to eliminate flooding potentials <br />under all conditions. <br /> <br />1.3) Due to the aesthetics, Mr. Nissan has requested his assessment for <br />Plat 89207 Parcel 4250 be deleted. <br /> <br />14) The parcel was reviewed by both the Building Official and City En- <br />gineer and they determined the lot to be buildable. <br /> <br /> <br />
