Councilmember Van Wagner introduced the following resolution and moved for its <br />adoption: <br /> <br />RESOLUTION ~82-59 <br /> <br />RESOLUTION TO AUTHORIZE SUBDIVISION OF CERTAIN PARCELS OF LAND OWNED BY WESTPHAL <br />CONSTRUCTION BY METES AND BOUNDS <br /> <br /> %'~IEREAS, Westphal Construction Co., Inc., hereinafter referred to <br />as "Westphal" is the owner of certain property on 154th Lane NW and 153rd Lane <br />NW lying between Xenon Street NW and He matite Street NW in the City of Ramsey, <br />which property was all known as Parcel 2000, Plat 89222 and which parcel is now <br />known on Anoka County's tax records as follows: <br /> <br />Plat Parcel PIN ~ <br /> <br />89222 2003 22-32-13-0025 <br />89222 2004 22-32-13-0026 <br />89222 2005 22-32-13-0027 <br />89222 2006 22-32-13-0028 <br />89222 2007 22-32-~13-0029 <br />89222 2008 22-32-13-0030 <br />89222 2115 22-32-14-0029 <br />89222 2116 22-32-14-0030 <br />89222 2001 22-32-14-0024 <br />89222 2002 22-32-14-0028 <br /> <br />and <br /> <br /> WHEREAS, the City of Ramsey, by Project #82-16, improved with blacktop <br />and drainage improvements 153rd Lane NW and 154th Lane NW; and <br /> <br /> WHEREAS, as a result of said Project ~80-16, the City assessed Parcel <br />2000 for five (5) units based on the then 2 ½ acre minimum lot size; and <br /> <br /> WHEREAS, subsequent to the assessment of Project ~80-16, Westphal <br />caused Parcel 2000 to be split into ten (10) units by metes and bounds subdivision <br />and said subdivisions were recorded and became new tax parcel units as above <br />described; and <br /> <br /> WHEREAS, the City, by this resolution, approves of the subdivision <br />of Parcel 2000 into ten (10) units based on evidence presented by Westphal to the <br />effect that Parcel 2000 had been surveyed into ten (10) units in 1972, that hereto- <br />fore the City had permitted these type sudivisions on 154th Lane and 153rd Lane <br />and issued building permits and that all of the other lots in the area are of <br />similar size; and <br /> <br /> WHEREAS, since five (5) additional building 'sites or units are created <br />by permitting the subdivision of Parcel 2000 into ten (10) units, which five (5) <br />additional units have not received assessments for Project ~80-16 but which five <br />(5) units benefit by Project #80-16; and <br /> <br /> WHEREAS, the City does not feel it would be economically feasible <br />to reassess all of Project #80-16 in order to assess the additional five (5) units <br />created by Westphal's subdivision; and <br /> <br /> WHEREAS, the parties agree that it is equitable for Westphal to pay <br />the City's required park fee for the additional five (5) units created by the <br />subdivision, which park fee is required by the City's subdivision code. <br /> <br /> <br />
