Councilmember S~teberg introduced the following resolution and moved for its <br />adoption: <br /> <br />RESOLUTION %82-61 <br /> <br /> WHEREAS, the City Council, City of Ramsey, Anoka County, State of <br />Minnesota has directed the City Staff to prepare a draft resolution requiring <br />that the alignment of all new street construction/reconstruction be centered <br />within the right-of-way; and <br /> <br /> WHEREAS, the City of Ramsey has improved numerous streets within the <br />City in response to petitions from the residents; and <br /> <br /> WHEREAS, the street improvements completed in the past have generally <br />been centered within the right-of-way unless undue costs or hardships would have <br />been created. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE'~'CITY COUNCIL., CITY OF RAMSEY, ANOKA COUNTY, <br />STATE OF MINNESOTA, as follows: <br /> <br /> 1) All future street construction/reconstruction shall be centered <br />within the right-of-way unless undue costs or hardships are created. Undue costs <br />and hardships shall be determined by the City Council and the relocation of ex- <br />isting streets shall not be determined as undue costs. Examples of undue costs <br />or hardships shall be dense forest, nonreplaceable trees or streets lying adjacent <br />to lakes, streams or swamps. However, in all cases the roadway shall be placed <br />within the right-of-way and adequate area shall be available for snowplowing. <br />Exceptions to this may be granted provided new right-of-way is acquired. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Councilmember Reimann and upon vote being taken thereon, the following voted in <br />favor thereof: <br /> <br />Mayor Gamec, Councilmembers Sorteberg, Reimann and Van Wagner (absent-Cox) <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City <br />Council this the 27th day of April, 1982. <br /> <br />Mayor <br /> <br /> ATTEST: <br /> <br />/ -.~ominist~ator/Clerk <br /> <br /> <br />
