Councilmember Van Wagner introduced the following resolution and moved <br />for its adoption: <br /> <br />RESOLUTION #82-84 <br /> <br /> WHEREAS, the City proposes to improve a portion of 167th Avenue <br />located between State Aid Highway #47 and County State Aid Highway #5; and <br /> <br /> WHEREAS, the improvement consists of widening the shoulders, <br />new blacktop mat and reconstructing said roadway including necessary storm <br />water drainage facilities where necessary in order to provide for the <br />safety of the traveling public; and <br /> <br /> WItEREAS, in addition to the existing highway easement, certain <br />lands in fee are required for said improvement together with (1) temporary <br />highway easements which expire on or before July 1, 1983, and (2) permanent <br />drainage and utility easements; and <br /> <br /> WHEREAS, the lands required are more particularly described as <br />parcels 1 - 26 of project #82-1 as prepared by the City Engineer. <br /> <br />NOW THEREFORE, BE IT RESOLVED, that the City Council hereby authorizes the <br />City Attorney to proceed to acquire the fee simple, permanent easements, and <br />temporary highway easements over said lands in accordance with Minnesota <br />Statutes. <br /> <br />BE IT FURTHER RESOLVED, that these lands as described above which cannot <br />be acquired by direct negotiation, shall be acquired by eminent domain and <br />the City hereby requests the City Attorney to file the necessary petition <br />therefore, and to prosecute such action to a successful conclusion or until <br />it is abandoned, dismissed or terminated by the City or Court. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded <br />by Councilmember Reimann and upon vote being taken thereon, the following <br />voted in favor thereof <br /> <br />Mayor Gamec, Councilmembers Van Wagner, Sorteberg, Reimann and <br />Cox <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey <br />City Council this the 1st day of June, 1982. <br /> <br /> ATTEST: Mayor <br /> <br />mi ' trator/Clerk ~.~ <br /> <br /> <br />
