Councilmember Sorteberg introduced the following resolution and moved for <br />its adoption: <br /> <br />RESOLUTION #83-83 <br /> <br />RESOLUTION AUTttORIZING DEVELOPMENT OF RAUDIO DONATED LAND <br /> <br />WHEREAS, Mr. Art Raudio donated land to the City of Ramsey; and <br /> <br /> WHEREAS, the City of Ramsey has been approached in regards to <br />developing this donated land into a park; and <br /> <br /> WHEREAS, the partial development of this land into a recreational <br />usc is to be accomplished by using volunteer labor and further, that no City <br />funding will be utilized.in this project. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> 1) That the City of Ramsey hereby authorizes the partial develop- <br />ment of the donated land for recreational development contingent upon the <br />City Staff determining as follows: <br /> <br />a) Development Plan - That the development plan meet the <br /> following criteria: <br /> <br />1) <br /> <br />Contain letter from State Highway Department <br />that they have approved the ingress and egress <br />to Highway #47; <br /> <br />2) <br /> <br />Access road to the recreational area comply <br />with City standards (blacktopping won't be <br />required); <br /> <br />3) Development plan shall be consistent with <br /> Park Board and Council recommendations; <br /> <br />4) <br /> <br />Expenditures of any City funds for said <br />projects shall require prior approval by the <br />Park Board and City Council (reason: no funds <br />were appropriated for said improvement in the <br />1983 budget.). <br /> <br />2) Legal and Liability - That the following will be accomplished: <br /> <br />a) <br /> <br />Ail volunteer labor will execute hold harmless document <br />stating that they will not make a claim on the City if <br />they are injured on project. <br /> <br />b) <br /> <br />Will have to comply with City Ordinance governing the <br />Wild and Scenic Rivers Ordinance and other City Codes <br />if applicable. <br /> <br />c) <br /> <br />No work shall be performed on the project by individuals <br />or entities using construction equipment unless they <br />present to the City a certificate of insurance giving <br />proof that they are fully insured to the minimum extent <br />of $500,000 per occurance for public liability purposes. <br /> <br />Page 1 of 2 <br /> <br /> <br />
