Motion by Councilmember Van Wagner to introduce the following Resolution: <br /> <br />RESOLUTION 83-134 <br /> <br /> WHEREAS, the Ramsey City Council by motion on November 13, 1978 and <br />again reaffirmed on April 26, 1983 granted a subdivision variance to permit the <br />subdivision of Lot 2, Block 2, Whispering Pines Plat 4 into two (2) equal lots <br />using a platted description, and <br /> <br /> WHEREAS, the legal description used for said division is not accurate <br />as it does not divide said Lot 2, Block 2, into two (2) equal lots as is the <br />intent of the subdivider, and <br /> <br /> WHEREAS, the only way to equally divide said Lot 2, Block 2 is by the <br />use of a metes and bounds description, and <br /> <br /> WHEREAS, the City Council now finds that it would create an undue <br />hardship on the property owner to not grant the variance to permit a metes and <br />bounds subdivision of said Lot 2, Block 2. <br /> <br />NOW, THEREFORE, BE IT RESOLVKD AS FOLLOWS: <br /> <br /> That Lot 2, Block 2, Whispering Pines Estates, Plat 4, Anoka County, <br />Minnesota, may be subdivided into two (2) equal lots using the following metes <br />and bounds legal descriptions: <br /> <br />A) The North 173.9 feet of Lot 2, Block 2, Whispering Pines Estates, <br />Plat 4, as measured along the East line thereof. <br /> <br />B) Lot 2, Block 2, Whispering Pines Estates, Plat 4, except the North <br />173.9 feet, as measured along the East line thereof. <br /> <br />The foregoing Resolution was seconded by Councilmember Schlueter and upon vote <br />being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec, Councilmember Schluter, Reimann, Van Wagner <br />and Sorteberg, <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />whereupon said Resolution was declared duly passed and adopted on this <br />23rd day of August, 1983. <br /> <br />~i ty~dmfnis t ~o~/C1 e~k - -- k~ <br /> <br /> <br />
