WHEREAS, the applicant, prior to furnishing the formal data required <br />by Section 170.014G has requested that the Council give an "indication" of its <br />position on the PUD; and <br /> <br /> WHEREAS, subsequent to the above described Planning and Zoning <br />Commission public hearing, residents adjacent to the proposed PUD met with <br />the developer to discuss their concerns and problems with the PUD, including <br />matters such as screening, density, highway location, landscaping and building <br />design; and <br /> <br /> WHEREAS, the adjacent residents and other members of the public are <br />concerned about segments of the overall proposed PUD being sold to developers <br />and parties other than the applicant/developer; their concern being what control <br />will the City maintain over the new developer with regard to those committments <br />and agreements given by the original applicant/developer; and <br /> <br /> WHEREAS, such an "indication" is not a formal part of Section 170.014G <br />approval procedure; and <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> 1) That the Council does hereby advise the applicant that the general <br />land use proposed looks favorable. <br /> <br /> Z) That not withstanding paragraph 1) above, the Council reserves the <br />absolute right to totally reject or modify the project, pending the requisite <br />documentation being presented, the requisite public hearing and grant of rezoning, <br />all as prescribed by City Code Section 170.014G. <br /> <br /> 3) That the Council will not grant final PUD approval or rezone the <br />subject property to a PUD zone unless and until City Code Section 170.014G <br />is fully complied with and the Council adopts the requisite findings for such <br />approval and rezoning. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Councilmember Reimann and upon vote being taken thereon, the following voted <br />in favor thereof: <br /> <br />Mayor Gamec, Councilmembers Van Wagner, Reimann, Schlueter and <br />Sorteberg <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey <br />City Council this the Z4th day of January, 1984. <br /> <br /> <br />
