-2- <br /> <br /> WHEREAS, said application is made pursuant to City Code Chapter No. <br />170.014(3 PLANNED UNIT DEVELOPMENT; and <br /> <br /> WHEREA~, the City's Planning Commission met on the 7th day of February, 1984 <br />at which time it reviewed the PUD application and made a written recommendation <br />to the City Council that the preliminary developmant plan for the PUD be <br />approved; and <br /> <br /> WHEREAS, on the 20th day of February, 1984 the City Council conducted a <br />public hearing on the application for the PUD which public hearing was properly <br />noticed by a publication in the City's legal newspaper on the 17th day of <br />February, 1984; and <br /> <br /> WHEREAS, issues regarding open space in the plat, restrictive covenants <br />relating to the keeping of junk cars and pets by the PUD residents, the <br />finalization of a homeowner's association and the burden of the PUD on parks, <br /> <br />schools, streets and other public facilities have yet to be fully resolved. <br /> I~OW, THEREFORE, BF. IT RESOLVF.D BY THF. RAMS~ CITY COUNCIL: <br /> <br /> 1. That preliminary Planned Unit Development approval is hereby granted to <br />FLINTW00D HILLS S~COND ADDITION, subject to review by the City's Planning <br />Commission of issues relating to open space, restrictive covenants relating to <br />the keeping of junk cars and pets, the homeowner's association and the burden of <br />the PUD on the City's parks, schools, streets and other public facilities. <br /> <br /> 2. That said preliminary Planned Unit Development is further subject to <br />the City's Planning Commission finding that the subject PUD is in substantial <br />compliance with that premilinary Development Plan previously recommended by the <br />Planning Commission. <br /> <br /> The motion for the adoption of the foregoing Resolution was seconded by <br /> <br /> <br />
