Commissioner Deemer inquired if Attomey Goodrich was confident he could give the Charter <br />Commission language to show the intent that's not full of legalize so it can be understood. He <br />expressed concern about the interpretation. <br /> <br />Attorney Goodrich responded in the positive. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Fischer to direct the City <br />Attorney to draft language to show the actual intent which is protection for the current residents <br />- in Chapter 8 of the City's Charter. <br /> <br />All in favor - motion carried. <br /> <br />Case #2: Council Vacancy Appointment <br /> <br />City Administrator Norman reported that this topic came out of a work session discussion with <br />the City Council last October. Council discussed how the City of Ramsey fills vacancies. This <br />situation happened in Anoka when Councilmember John Weaver passed away - they filled the <br />vacancy by appointment - not a special election. <br /> <br />Attorney Goodrich stated that the longest term without an election would be two years. <br /> <br />Mr. Norman added that it could be a special election but would be held on a regular election day <br />- there has been no language drafted yet relating to this issue. <br /> <br />Mr. Goodrich stated that out of 850 cities in the State of Minnesota, about 80 of them are Charter <br />cities. Seven hundred fifty cities appoint for a Council vacancy mid-term, however, if it is more <br />than two yeas, they have a special election but it is held on the day of the regular General <br />Election. <br /> <br />Commissioner Deemer stated he would assume this special election on the General Election day <br />would have a filing date. If there are more than two people filing, we would have to hold a <br />Primary. <br /> <br />Mr. Norman agreed with Mr. Deemer. <br /> <br />Commissioner Deemer stated that when we started the ward system, we had some problems with <br />this language. <br /> <br />Commissioner LaMere added that the Charter knew Chapter 4 would have to be revisited. <br />Commissioner Ebel noted that section 4.5.5 has to be amended for sure. <br /> <br />Chairperson Vogt added that there definitely has to be some language changes. <br /> <br />Charter Commission - April 27, 2006 <br /> Page 4 of 6 <br /> <br /> <br />
