WHEREAS, the City Council adopted Findings of Fact on the proposed P.U.D. on June 11, 1985; and WHEREAS, the entire P.U.D. shall be subject to restrictive covenants and conditions in order to maintain the appearance of the development. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA 00UNTY, S~ATE OF MINNESOTA, as follows: 1) That preliminary approval of the Northfork Planned Unit Development is hereby granted. 2) That final approval of the Northfork Planned Unit Develo~ent is hereby granted subject to the following: a) That North Fork, Inc. and the City enter into a comprehensive development agreement which agree- ment shall incorporate all City Code requirements and City policies relating to a development of this nature; and b) That the Applicant comply with each item contained in the City Engineer's letter dated June 5, 1985 and addressed to the Mayor and City Council; and That there be an agreement for the financial respon- sibility relating to Ramsey's and the Applicant's share of the improvement of Jarvis Street adjacent to the subject plat; and d) That the City of Ramsey receives a proper legal description of the subject property as approved by the City Attorney; and e) That the plat may not be filed until the P.U.D. Zoning Ordinance is effective. The Developer is advised that any on-site improvements constructed prior to filing of the plat will be made at its risk. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Sorteberg and upon vote being taken thereon, the following voted in favor thereof: Mayor Heitman, Councilmembers Sorteberg, Cox, Reimann and Schlueter and the following voted against the same: None Resolution #85-110 -2-
