WHEREAS, the City Council adopted Findings of Fact on the <br />proposed P.U.D. on June 11, 1985; and <br /> <br /> WHEREAS, the entire P.U.D. shall be subject to restrictive <br />covenants and conditions in order to maintain the appearance of <br />the development. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA 00UNTY, S~ATE OF MINNESOTA, as follows: <br /> <br /> 1) That preliminary approval of the Northfork Planned Unit <br />Development is hereby granted. <br /> <br /> 2) That final approval of the Northfork Planned Unit <br />Develo~ent is hereby granted subject to the following: <br /> <br />a) <br /> <br />That North Fork, Inc. and the City enter into a <br />comprehensive development agreement which agree- <br />ment shall incorporate all City Code requirements <br />and City policies relating to a development of <br />this nature; and <br /> <br />b) <br /> <br />That the Applicant comply with each item contained <br />in the City Engineer's letter dated June 5, 1985 <br />and addressed to the Mayor and City Council; and <br /> <br />That there be an agreement for the financial respon- <br />sibility relating to Ramsey's and the Applicant's <br />share of the improvement of Jarvis Street adjacent <br />to the subject plat; and <br /> <br />d) <br /> <br />That the City of Ramsey receives a proper legal <br />description of the subject property as approved <br />by the City Attorney; and <br /> <br />e) <br /> <br />That the plat may not be filed until the P.U.D. <br />Zoning Ordinance is effective. The Developer is <br />advised that any on-site improvements constructed <br />prior to filing of the plat will be made at its <br />risk. <br /> <br /> The motion for the adoption of the foregoing resolution was <br />duly seconded by Councilmember Sorteberg and upon vote being <br />taken thereon, the following voted in favor thereof: <br /> <br />Mayor Heitman, Councilmembers Sorteberg, Cox, Reimann and <br />Schlueter <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />Resolution #85-110 <br /> <br />-2- <br /> <br /> <br />
