Councilmember Cox introduced the following resolution and moved <br />for its adoption: <br /> <br />RESOLUTION #86-173 <br /> <br />RESOLUTION DEFERRING STREET IMPROVEMENT SPECIAL ASSESSMENT, <br />SEALCOATING IMPROVEMENT PROJECT #86-4 (COUNTRYSIDE ESTATES); Case <br />of Mr. Bernhard G. Riewe, 17412 Unicorn Street N.W. <br /> <br /> WHEREAS, Mr. Riewe requested by application on October <br />3, 1986 that his street improvement special assessment for <br />sealcoating in the amount of $167.70 be deferred as provided by <br />City Code Chapter 210.012H. <br /> <br /> WHEREAS, City Code Chapter 210.012H provides for the <br />deferrment of paying special assessments when the property owner <br />makes written application and falls whithin the purview of this <br />City Code; and <br /> <br /> WHEREAS, the Ramsey City Council is aware that City <br />Code Chapter 210.012h, Subparagraph 5A(b) requires that the <br />special assessment to be deferred must exceed $300.00; however, <br />the City Code further states that the Council may consider <br />exceptional and unusual circumstances when applying the Code <br />r equ ir emen t s. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> 1) That the City Council hereby grants Mr. Riewe, 17412 <br />Unicorn Street N.W. deferral of his special assessment for public <br />improvements as stated above in the amount of $167.70. <br /> <br /> 2) That interest on the deferred assessment shall be <br />accrued at the same rate as on non-deferred assessments. The <br />maximum amount due on the assessment will be the original <br />assessment plus interest accrued during the original assessment <br />term. <br /> <br /> 3) Termination of right to deferred payment - The <br />option to defer the payment of special assessments shall <br />terminate and all amounts accumulated plus applicable interest <br />shall become due upon the occurrence of any of the following <br />events: (a) the death of the owner, provided that the spouse is <br />otherwise not eligible for the benefits of this section; (b) the <br />sale, transfer or subdivision of the property or any part <br />thereof; (c) if the property should for any reason lose its <br />homestead status; or (d) if for any reason the City Council shall <br />determine that there would be no hardship to require immediate or <br />partial payment. <br /> <br /> 4) That it is hereby directed that the City Finance <br />Officer establish a deferred assessment roll in the City for <br /> Resolution #86-173 <br /> <br />Page 1 of 2 <br /> <br /> <br />
