WHEREAS, said application is pursuant to City Code <br />Chapter 170.016K; and <br /> <br /> WHEREAS, the City Council approved the development plan <br />for the P.U.D. on June 11, 1985; and <br /> <br /> WHEREAS, on June 17, 1986, the Ramsey Planning and <br />Zoning Commission reviewed the plat of Northfork Seconds for <br />consistency with the original P.U.D. developmetn plan and found <br />it to be in substantial compliance with that plan; and <br /> <br /> WHEREAS, the entire P.U.D. and plat of Northfork Second <br />are subject to restrictive covenants and conditions in order to <br />maintain the appearance and character of this planned unit <br />development. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> 1) That final plat approval of Northfork Seconds is <br />hereby granted subject to the following: <br /> <br />That the developer and City shall enter into an <br />agreement which shall incorporate all City Code <br />requirements and City policies relating to a <br />development of this nature. This agreement shall <br />also incorporate restrictive covenants which will be <br />effective and binding to property owners in the <br />development. <br /> <br />That the developers shall provide proof of <br />marketable title of the subject property to the <br />City. <br /> <br />The motion for the adoption of the foregoing resolution was duly <br />seconded by Sorteberg and upon vote being taken thereon, the <br />following voted in favor thereof: <br /> <br />Mayor Reimann <br />Councilmember Cox <br />Councilmember DeLuca <br />Councilmember Schlueter <br />Councilmember Sorteberg <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />Resolution #86-193 <br /> <br />Page 3 of 4 <br /> <br /> <br />
