Councilm(:mbc; St ~rtcbcrg introduced the following resolution and moved for its adoption: RESOLUTION 88-101 RES()LIJTI~ON AUTHORIZING THE ACQUISITION OF FEE TITLE TO CERTAIN REAL PROPERTY FOR STREET IMPROVEMENT, SANITARY SEWER AND WATER TRUNK AND STORM WATER TRUNK PURPOSES. WIlEREAS~ thc City of Ramsey proposes to construct water main, sanitary sewer, storm drainage and st r¢c.t improvements, which projects are generally known as Improvement Projects 87-18 and 87-25, which projects will require the acquisition of certain real property as described on the attached E×?tibit "A"; and WHEREAS, ,h,.z improvements are necessary in order to provide for the health, welfare and safety of the residents of the City of Ramsey; and WHEREAS.~ ire i~.amsey City Council finds that it is in the public's interest, that the project be expedited m ~h{: c.'.: tent allowable by law and that there is a need to acquire use of the real property prior to the ~.tw~ rd ,)f thc court-appointed commissioners. NOW, TIII~;RE~,~ORE, BE IT RESOLVED BY THE CITY CITY OF RAMSEY, ANOKA COUNTY, STATE OF FOI,I.A)W,q: COUNCIL OF THE MINNESOTA, AS Tl'~at ~hc s~mitary sewer trunk, water trunk, storm water trunk and street improvements as descri b~d i~¢rein are public projects and that the real property is reasonably necessary and convcmem to the furtherance of said public projects and the acquisition of interests in the real property as described herein will further the public health, welfare, safety and co~v¢ ni e~ ~:e of the City of Ramsey. Tt-~a~ 1[,'~ t',mnsey City Council hereby authorizes the City Engineer, Mr. Peter R. Raatikka of ~ la kmtson Anderson Associates, Inc., to proceed to acquire the fee title and easement rights ~(~ s~ icl real property in accordance with Minnesota Statutes and the City Charter. Thal it' ~h¢ interests in the real property as described above cannot be acquired by direct negt'~timi,~ it shall be acquired by eminent domain and the City Council hereby requests the City Altc~rney to file the necessary petition therefore, and to prosecute such action to a suc:cct~sfi~l conclusion or until it is abandoned, dismissed or terminated by the City or Court and ~() acq~ tire possession of the real property as described on attached Exhibit "A" prior to ~h(: :twt:r(t:, being issued by the court-appointed commissioners pursuant to the "Quick- take" pr(~t:,.:durcs of Minn.
