CouncilnJen-rl',¢~r I)eLuca introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #88-163A <br /> <br />RES()LIJTI{)?~' DETERMINING THE SUFFICIENCY OF A PETITION FOR <br />ORDINANCE <br /> <br /> WI[EREAS, the City Council, on July 14, 1988, held a public hearing to consider Atlas <br />Incinerat(~r, lnc.'~; request for a conditional use permit to construct and operate a contract burn <br />facility in fl'~¢ Ciiy of Ramsey; and <br /> <br /> WI[I4REAS, the City Council, on July 27, 1988, denied Atlas Incinerator, Inc.'s <br />request for a c~ ~Jditional use permit to construct and operate a contract burn facility in the City of <br />Ramsey; m~.d <br /> <br /> WIIIEI(1,;AS, a petition asking that an ordinance prohibiting the construction of contract <br />burning fi~ci b ties ~md any other commercial incinerators within the City of Ramsey be adopted was <br />filed in lhe otlicc ~f the City Administrator on July 25, 1988; and <br /> <br /> WI [!~;[~I~;/'~.S, the City Administrator shall report to the City Council within ten days of <br />receipt of a p{,.~itio~t for ordinance on the sufficiency of such petition; and <br /> <br /> WIIER EAS, the required number of signatures of registered voters is ten percent of the <br />total num[~:~ ~ff repistercxl voters at the time of the last City-wide election; and <br /> <br /> W~I~¢Itl,;/~S, the last City-wide election was April 19, 1988 in which 5,571 persons <br />were registered to vote, thereby requiring that to be sufficient, a petition for ordinance must have <br />570 si gnam re,; ~ ~f ~%i stcred voters; and <br /> <br /> W.~iEltl~;AS, a petition for ordinance must adhere to the general provisions found in <br />Chapter 5 ~>t' the (?i ty Charter. <br /> <br />NOW TIIlEREF~IRE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMS~_iY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That th.{,; ( ~.i~.y Council finds that the petition submitted to the City Administrator on July 25, <br />19118 aski~l,, that an ordinance prohibiting the construction of contract burning facilities and <br />~my t,thc:r t:ommercial incinerators within the City of Ramsey be adopted contains 709 <br />sigm~lu'cs, ~t' registered voters which is sufficient by 139 signatures. <br /> <br />2) <br /> <br />That th~ (~ty Council finds that, based upon the report of the City Administrator, the <br />:ffo;cmenlioned petition is sufficient and orders the City Administrator to deliver a copy of <br />Ire pc;tiff o~, together with this resolution, to the sponsoring committee in accordance with <br />the City Ch:~rtcr. <br /> <br />Thc motiot~ l(,r il'm adoption of the foregoing resolution was duly seconded by Councilmember <br />Bawden an~'i ~tgon vole being taken thereon, the following voted in favor thereof: <br /> <br /> <br />
