Mayor Re, ira;mn imroduced the following resolution and moved for it adoption: <br /> <br />AMENDMENT AGREEMENT NO. 3 <br /> <br />RESOLUTION #88-234 <br /> <br />RESOLUT~DN TRANSFERRING COMMUNITY TELEVISION PROGRAMMING <br />RESPONSIBIL.gTIES FROM CABLE TV NORTH CENTRAL, INC. TO THE <br />QUAD CITIES CABLE COMMUNICATIONS COMMISSION. <br /> <br /> WHEREAS, The Cable Communications Franchise between Group W of the Quad Cities <br />d/b/a Cab!e T'q North Central Incorporated (hereinafter "Company") and the four Member Cities of <br />the Quad Ci~ics (Cable Communications Commission (hereinafter "Commission") requires the <br />Company to provide and maintain certain cable television program facilities and equipment, <br />provide certair~ community access channels and provide certain cable programming staff as <br />delineated irt the Offering as defined in the Ordinance; <br /> <br /> WHEREAS, the Company has proposed divesting itself of all responsibility for <br />providing the above-mentioned support for community television programming; <br /> <br /> WIlIERI~;AS, the Commission has investigated the possibility and ramifications of <br />assuming the responsibility for community television programming within the Quad Cities area; <br />and <br /> <br /> WHEI{EAS, the Commission and the Company have negotiated mutually acceptable <br />terms to ,~.f~¢:c~ the transfer of the community television function from the Company to the <br />Commissicm tis de}ineated below. <br /> <br />NOW, ~ItlEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY ()~' P, AMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That ,~:t~,:z Quad Cities Cable Communications Commission agree with Cable TV North <br />Cent ml Incorporated to the following terms and conditions: <br /> <br />'Fha: Commission will assume all responsibility for community cable television <br />programming delineated (as of the date of this agreement) in the offering and <br />required by the ordinance within or for the four (4) Member Cities of the Quad <br />t~it3es geographic territories. <br /> <br />'~'h{ Company is relieved of all responsibility for providing community cable <br />television programming delineated (as of the date of this agreemen0 in the offering <br />m~d required by the ordinance within or for the four (4) Member Cities of the <br />t~o~ nmission, except for those responsibilities delineated by this Agreement, and <br />t'ur.ther, except for its customary responsibilities of delivery of signal and <br />~r~,ai atenance of the cable system to accomplish such delivery. <br /> <br /> Company shall transfer to the Commission title to and ownership of all <br />(quipment listed in Exhibit A, attached hereto and made a part hereof. <br /> <br />Thc Company shall make available for the term of the Franchise and any renewals <br />thereof for use by the Commission and its Member Cities those channels currently <br />rm ~'he Quad Cities cable system and currently known as the Public Access Channel <br /> <br />RESOLUTION #88-234 <br />Page 1 of 4 <br /> <br /> <br />
