Coundlmember I}.~;Luca introduced the following resolution and moved for its adoption: RESOLUTION #89-06-133 RESOLUTION )'-:0~ VACATING OF EASEMENTS WHEREAS, certain drainage and ponding, street and utility, and trailway easement.'; hsv~ b~:e,n acquired by the City during the development of the NORTHFORK P.U.D.; and W~EREAS, certain of said easements are no longer necessary for use by the City and the public; W.F~EREAS, the original need of the City for said easements has been replaced by other easeme~d~ which adequately address the City's requirements; and Wi-~EREAS, the developer of the NORTHFORK P.U.D. has requested that the City vacate the s~id ,-;asements; and WHEREAS, M.S.A. 412.851 entitled "Vacation of Streets" permits the City Council to va(:;~.ie [',ublic grounds and public ways; and WHEREAS, on June 13, 1989 the City held a public hearing on the issue of vacating the .,;aid ~.,asements in the NORTHFORK P.U.D., which public hearing was preceded by two week,'; pubiished notice in the Anoka County Union and posted notice and at which public hearing all rm;mbem of the public present were given an opportunity to be heard; and Wfr~iEREAS, after consideration of all relevant factors, the City Council finds that it is in i:l'~; best interest of the public to vacate the said drainage and ponding, street and utility, and tr;dlwav easements.
