RESOLUTION FOR CONS~'R §117.042, WHEI~iE, authorized Cit~ for 153rd Avelue WHEEZE, proceed as necessary p~ls NOW THEREF OF introduced the following resolution and moved for its adoption: RESOLUTION #90-01-33 AUTHORIZING CERTAIN STREET AND UTILITY EASEMENTS 3CTION OF 153RD AVENUE BY USE OF MSA §117.011 AND t,$, on December 19, 1989, the City Council by its Resolution #89-12-350 ff.f to acquire either by negotiation or eminent domain proceedings right-of-way N.W. which is known as City Improvement Project #89-4; and t~, the Council finds that it is in the City's best interests that the project to y as possible and that therefore the City acquire title and possession of the ~i'ior to the filing of an award by the Court-appointed Commissioner. ~RE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY ~NOKA COUNTY, STATE OF MINNESOTA, as follows: 1 ) That th~.~.tY Council hereby authorize the City Attorney to proceed to acquire the perpetual easemehts~ described in City Resolution #89-350 in accordance with Minnesota Statutes. 2) That th,~$e~ands as described above which cannot be acquired by direct negotiation shall be acquffe~eminent domain and to take title and possession of that land prior to the filing of a~:~w~!d by the Court-appointed Commissioner, pursuant to Minnesota Statute 3) Thai L~ ~ky Council hereby requests the City Attorney to file the necessary petition theref0~e ~d to prosecute such action to a successful conclusion or until it is abandoned, dismi~si d t terminated by the City or Court.
