Councilmcnll~cr l)cI.uca introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #90-02-48 <br /> <br />RESOLUTI()N STATING CITY'S POSITION WITH RESPECT TO CANDIDATE <br />LANI)FIIJL" <br /> ,~ FI:'E BUFFERS <br /> <br /> WItERI,;AS, candidate landfill Site P is situated within the City and has nearby <br />residential devcl~pment to the northwest and southeast of the site; and <br /> <br /> Wllf;RE/~,S, landfill operations within 5000' of a runway used by piston aircraft are <br />considered io [x~ if:compatible; and <br /> <br /> WIIERE/~.S, landfill operations and related landfill activities have the potential to <br />adversely impact ~um'ounding land uses; and <br /> <br /> WIIERI,;/~,S, the intent of Chapter 325 laws of 1989 and MSS 473.823, Subd. 3 is to <br />ensure that btfffc, r areas, at a minimum, protect surrounding land uses from adverse or <br />incompatibl(; impacts due to landfill operation and related activities; and <br /> <br /> WI[$;R E?~S, landfill related activities are herein defined to include but are not limited to <br />long-term ex~mvati~on activities, placement of waste fill, stockpiling of materials for liner, interim <br />and cover rcq uirer.qents, borrow operations for liner, interim and cover materials, soil modification <br />operations, ~md cct~fipment storage; and <br /> <br /> WIlEREAS, the Metropolitan Council is in the process of defining the term "buffer <br />area" and csl~bli:~h ing criteria and policies for buffer areas. <br /> <br />NOW Tlll,;REFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, AS FOLLOWS: <br /> <br />That irc City state its position to the Metropolitan council and to the legislature clearly <br />stq~poFth~g the need for buffer areas which separate and protect surrounding land uses from <br />lar, d lill :~pc ration s and related landfill activities. <br /> <br />Th at thc; Cty staff is directed to work with Metropolitan council, other regulatory agencies <br />and thc legislature to promote a policy which will be consistent with legislative intent in <br />Chal,tO~ 37_5, laws of 1989 and MSS 473.823 subd. 3. <br /> <br />That the City ol)pose usurpation of reasonable control over landfill activities through zoning <br />overrides by other governmental jurisdictions or private entities <br /> <br />The motion f,)r th~z adoption of the foregoing resolution was duly seconded by Councilmember <br />Pearson a~d t~[>oi~ qote being taken thereon, the following voted in favor thereof: <br /> <br />and thc fi)llowi ~:g voted against the same: <br /> <br /> <br />
