Councilmem bcr Cich introduced the following resolution and moved for its adoption: RESOLUTION #90-03-083 RESOLUTe(ON SUPPORTING CITY STAFF DETERMINATION THAT USE OF AND IMPR(~VEMENTS TO PIN 36-32-25-21-0006 BY WCCO ARE PERMISSII~LE UNDER SECTION 170.015H OF THE CITY CODE (NON- C()NFORM IN(;~ USES) WHEREAS, PIN 36-32-25-21-0006 is located in the City of Ramsey, and is legally described as follows: The iqorth(,ast Quarter of the Northwest Quarter of Section 36, Township 32, Range 25, Anok ~ Cou my, Minnesota, described as follows: Commcr~ci~tg at the northeast corner of said Northwest Quarter; thence south along the east linc tbercuf 936.25 feet to the centerline of a town road; thence northwesterly to the right delleci ion angle 96 degrees 41 minutes a distance of 604.08 feet; thence north parallel with the ca~t !in,~ of said Northwest Quarter a distance of 865.73 feet, more or less, to the north linc of said Northwest Quarter; thence east along the north line thereof a distance of 600.00 feet, n tore (~r less, to the point of beginning. WI~IERE^ S~ the City of Ramsey considers the radio antenna on the property to be a non- conforming u:~c; and W~IER [,;AS, Ramsey City Code Section 170.015H establishes criteria allowing for the continuance of ,~(>~-conforming uses; and WIlEI{I,;/'~S, the City of Ramsey received a letter from Attorney Mark Hamel dated November 27, 19~9, a copy of which is on file with the City of Ramsey, indicating WCCO's interest in purchasing the subject site for use as a stand-by radio transmission facility with certain improvemcnt,~;; an( WHEREAS, representatives of WCCO and City Staff met on January 16, 1990 to review the proposexl use or and improvements to the subject site; and WIIERE/kS, City Staff determined that the proposed use of and improvements to the subject property ¢:rc within the criteria allowing for the continuance of a non-conforming use according Io P, amsey City Code Section 170.015H. NOW, TtlEREVORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That thc City Council supports City Staff determination and hereby authorizes the issuance of a letter to WCCO in substantially the form attached hereto, indicating that the proposed usc t~f and improvements to the subject property as described in a letter to the City of Ramscy Planning Assistant Sylvia Frolik from Attorney Mark Hamel dated November 27, 1989, :~'c. ~)crmissible under Ramsey City Code Section 170.015H (Non-Conforming Uses).
