Councilmcw&:r I.,eLuca introduced the following resolution and moved for its adoption: RESOLUTION #90-05-133 RESOLUTION DEFEATING PROPOSED IMPROVEMENT PROJECT #89-22 - CAROLINE ACRES (BITUMINOUS SURFACING OF XENOLITH STREET N.W. AND iI7gTH LANE N.W.) WHEREAS, a resolution of the City Council adopted the 23rd day of January, 1990, fixed a date l:(~r a Council hearing on the proposed improvement of bituminous surfacing to Caroline Acres Addition (Project #89-22); and WHEi[~EAS, the required sixty (60) days has elapsed following the public hearing; and WIIEI~EAS, ten days' mailed notice and two weeks' published notice of the heating was given, and the hearing was held thereon on the 13th day of February, 1990 at which time all persons desiring to tx: heard were given an opportunity to be heard thereon; and WHEREAS, the Ramsey City Council has received a petition in opposition to the proposed projec~t signed by nine property owners representing 50 percent of the affected property owners on thc ! 3th day of March, 1990. NOW TIlEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA: 1) That thc p3oposed Improvement Project #89-22 (bituminous surfacing of Xenolith Street N.W. And 178th Lane N.W.) is hereby disallowed as proposed in the Council resolution adopted th~: 23rd day of January, 1990. 2) The propo~;ed Improvement Project #89-22 may not be considered for a period of one year from Ihe 13th of February, 1990 as stated in Chapter 8 of the Ramsey City Charter.
