Councilmcmber Pearson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #90-06-195 <br /> <br />AUTIIORiZATION FOR ACQUISITION OF CERTAIN PROPERTY BY <br />USE OF MSA §117.011 AND §117.042 FOR STREET AND UTILITY <br />PURPOSES FOR CONSTRUCTION OF 153RD AVENUE N.W. <br /> <br /> Wll EI;:EAS, on December 19, 1989, the City Council by its Resolution//89-12- <br />349 authorized the City Attorney to acquire either by negotiation or eminent domain <br />proceeding right-of-way for the construction of 153rd Avenue N.W. which project is <br />known as (Sty ~_mprovement Project//89-4; and <br /> <br /> WIlE}-k. EAS, the improvement consists of constructing a roadway which is <br />necess:~ry lot the safety and convenience of the traveling public; and <br /> <br /> WI IEREAS, fee title to certain of the right-of-way and a permanent easement and <br />temporary ca:~cments are required over certain lands for improvement construction; and <br /> <br /> WllEkEAS, the City has the authority to acquire right-of-way for said street by <br />eminent domain pursuant to Minnesota Statute § 117; and <br /> <br /> WIIEI~EAS, the City has the right to acquire the right-of-way prior to the filing <br />of an aw:~rd by the Court Appointed Commissioners, pursuant to Minnesota Statute <br />§117.011i and 5117.042; and <br /> <br /> WtlE14EAS, on January 23, 1990, the City Council by its Resolution g90-01-33 <br />authorized ~h at the 153rd Avenue Improvement Project proceed as quickly as possible and <br />directed that the City proceed pursuant to MSA § 117.042; and <br /> <br /> WilEREAS, the City Attorney has retained an appraisal firm and has been <br />supplied with completed appraisals for each of the several parcels; and <br /> <br /> V¥1IEREAS, pursuant to Resolution 4/89-12-349 the City Attorney has <br />negotiated witL, the several landowners and has reached a negotiated settlement with several <br />of them; a~_d <br /> <br /> VitlE[-:EAS, the City Attorney has been unable to reach a negotiated settlement <br />with. several other of the landowners. <br /> <br />NOW ~I'}IEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as <br />follows: <br /> <br />1) <br /> <br />'l'ha~- th~.: City Council hereby authorizes acquisition of land by eminent domain and <br /> take title and possession of that land prior to filing of an award by the Court <br />Appoi r: ted Commissioners pursuant to Minnesota Statute § 117.011 and § 117.042. <br /> <br /> <br />
