Council mcmb~:r' I¢~-l.uca introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #90-10-340 <br /> <br />RESOI,IJT~(~rq REQ'UESTING RELIEF FROM THE FEDERAL HOUSING <br />ADMINIS'fRA~t'ION (FHA) REQUIREMENT TO MEET THE METROPOLITAN <br />COUNCH, (]ENERAL RURAL USE DENSITY POLICY <br /> <br /> W I ~ 15;R l';kS, i t h as been brought to the attention of the City of Ramsey that the Federal <br />Housing Ad~rdnistration (FHA) has recently implemented procedures which deny FHA loan <br />approwtl '~n con-mmnities in which the minimum density policy is not in conformance with the <br />policies adop~{:~[ b7 the Metropolitan Council as amended in 1987; and <br /> <br /> WI!!E~!~I,;/~S, the City of Ramsey has adopted ordinances which became effective <br />January 1~ 1990 placing the City of Ramsey in strict compliance with the polices adopted by the <br />Mctropoli~a~ ('?turmoil; and <br /> <br /> WII[~;P,E/~S, thc City of Ramsey has submitted revisions to its comprehensive plan <br />which ha,,,c beem implemented by the aforementioned ordinances to the Metropolitan Council for <br />review am t ~'-.td).~;cq~znt approval; and <br /> <br /> WlI15;I,IEAS, the City of Ramsey does not confer to the Metropolitan Council (a <br />Regional !~l:t~nin~,. Advisory Body) the ability to plan its growth but rather intends to retain that <br />local control ;t:s ?rr,vided by Minnesota Statutes 462.358, et al; and <br /> <br /> W[It~RE/'-~S, it is the opinion of the City of Ramsey that the denial of funding from the <br />FIIA is conl'is(:;!rory, an unlawful taking of private property without compensation, and <br />nnnecessm'y ~tnd tmlawful interference with local government prerogative, and a grossly unfair <br />treatment of p~i,,,:~,.~' property rights; and <br /> <br /> Wlt~:RE/,~S, it is the opinion of the City of Ramsey that the adoption of exclusionary <br />policies by ~h~ ~;IIA is similm'ly unlawful, unwarranted, and unconstitutional; and <br /> <br /> W l lEli~ EAS, the City of Ramsey has in force and effect, those ordinances which protect <br />such amenilit:s ~ts ihe wild and scenic river, shoreland management, flood plain management, and <br />further rej,,ulal:~:s ~esidential development by the adoption of such ordinances as on-site septic <br />system rogulzdion, zoning requirements, platting requirements, and density standards which are in <br />conformanc~ wi~h the Metropolitan Council's policies, all of which work toward protecting the <br />general heal~ h, ..vt_:} fare and safety of the residents of the City of Ramsey. <br /> <br />NOW Ttll,;ilEFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSt~;¥, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That ti~c c.~:clusionary funding policy adopted by the Federal Housing Administration be <br />revokt:d immediately and making that funding source available to new housing located <br />anywh{~'~"c within the City of Ramsey. <br /> <br />2) <br /> <br />Theft thc: ~'cgtdation and control of the growth and development of the City of Ramsey be <br />retm'~et~ io the City Council as elected officials responsive to the needs of its residents and <br />in {;t'mlk):-m:mce with the approved comprehensive plan of the City of Ramsey and that the <br />FI3A di.,:r:t);~linue using the Metropolitan Council as the cleating agency for FHA loans. <br /> <br /> <br />
