Cotmcilmc~¢~ct' DcLuca introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #90-12-373 <br /> <br />RESOLUT}ON AU'FHORIZING THE CITY OF RAMSEY TO ENTER INTO AN <br />EASEMENT ACQUISITION AND ASSESSMENT AGREEMENT FOR THE <br />MCKIN~,EY STREET EXTENSION <br /> <br /> WilEI~ EAS, the City Council of the City of Ramsey has constructed a sanitary sewer <br />trunk alor~g ti~c l)t',~posed McKinley Street N.W. extension as Improvement Project #87-19; and <br /> <br /> Wtlt;i~: EAS, City Staff has negotiated a proposed agreement for the acquisition of an <br />80' wide ~ighr-, ~i:.'..vay fbr the McKinley Street N.W. extension as follows: <br /> <br />l) <br /> <br />City at its expense will construct a street and storm sewer system along <br />~-ight of-way using tax increment financing. <br /> <br />2) :l'h,: City at its expense will install watermain prior to constructing the street. <br /> <br />landowners will not be assessed for the street construction since it will <br />l)aid for by tax increment financing. <br /> <br />4) <br /> <br /> cost of trunk watermain or sanitary sewer will not be assessed to <br />i)c~efiting property owners, however, at the time the land is developed, the <br />(!c,,elopcrs will be required to pay a service availability surcharge (SAS) <br />.,,,,he:~ connection is made to the utilities. The landowners will be <br />,'csgonsible, at their own expense, for the construction of any water and <br />:',('.,?ct laterals needed for their respective future land development. <br /> <br />5) <br /> <br />h~ ~eturn for the City's commitments contained in items one and two above, <br />il~c landowners will convey to the City marketable title to the necessary 80' <br />dg tl-.o['.~way. <br /> <br />NOW TIIE]{}~}FORI~;, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSI,;V~ ~\NOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />Thai th~ City Council hereby authorizes the City Attorney to prepare easement acquisition <br />and as.';{;.~;s~nel~t agreements between the City and the landowners (Mr. Spohn and Ramsey <br />6'7 h~d~:;~d:~i Park) based upon the terms stated above. <br /> <br />2) <br /> <br />~l'h al rix, (ii ty Council hereby authorizes the Mayor and City Administrator to sign on behalf <br />of the (:iiy and the easement acquisition and assessment agreements with Mr. Spohn and <br />thc te.a~/~.,;%, 67 Industrial Park partnership. <br /> <br />Thc motion ir,r ih',: adoption of the foregoing resolution was duly seconded by Councilmember <br />Pearson and tq~)i~ vote being taken thereon, the following voted in favor thereof: <br /> <br /> <br />
