<br /> WI ~i;l~ E 4S, the City and David Hartley entered into an Employment Agreement dated
<br />January 28, i sc~o:, and
<br />
<br /> WIi!Ii,;I',EAS, said Employment Agreement, Paragraph 3, provides for a three (3) year
<br />term with on, z/ca~' continuafio~ increments; and
<br />
<br /> W}~I~;I{EAS, on January 3, 1990, the City Council by Motion entered into a renewal
<br />agreement w ii h David t tartley for an additional two year period of employment, for the years 1990

<br /> WI.i E REAS, the City Administrator, effective December 31, 1990, has offered to submit
<br />his resign;:~io~ l'~'o,n mnployment with the City as City Administrator; and
<br />
<br /> W ! [i,; l-ll~; A S, in consideration for said resignation, City Administrator David Hartley
<br />desires thc'cc (3) n tonth's severance pay; and
<br />
<br /> WIIEi.:~,;AS, without said resignation the January 28, 1986 Employment Agreement and
<br />its Janua~'y 3, t990 amendment could be interpreted to require the City to continue City
<br />Administrato~' ~)~vid t tm'tley's en'~ployment through December 31,1991; and
<br />
<br /> Wlll,;b~E/iS, the Council finds, at this time, that it is in the best interest of the City to
<br />accept David i lartley':; resignation in consideration of the City's payment of three (3) months'
<br />
<br /> Wli }.';i¢EAS, MSA 465.72 permits the City to pay severance pay to an employee leaving
<br />employm{mi: with ~he City provided the severance pay does not exceed an amount equivalent to one
<br />year of pay.

<br />NOW, rI'I~.EIIEFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
<br />CITY OF RA~V!SEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows:

<br />'l'h:tt tho January 28, 1986 Employment Agreement as amended by the Council's
<br />;~clion of January 3, 1990, is amended to provide that in consideration for David
<br />: !m'tley's resignation as City Administrator effective December 31, 1990, the City
<br />~d~li pay to him a lump sum severance payment in an amount equal to three
<br />~r~,~rh's compensation. The severance pay shall include, salary, accrued vacation,
<br />:~cc c~ ~ed sick leave, health insurance contribution and retirement plan contribution.
<br />I'1~-. severance pay paid to David Hartley pursuant to this Resolution shall be paid
<br />based upon what his salary related benefits would have been on March 31, 1991,
<br />which salary and benefits are as proved for in the Council's amendment of his
<br />i:.~.~91oyment Agreement on Janum'y 3, 1990.

<br />.~'csignation, David Hartley shall cooperate with the City by providing information
<br />wh.:n requested and appearing as witness for the City of Ramsey in any state or
<br />;cdcral court. Any business related expenses (e.g., meals, travel and lodging)
<br />i~c~ red during this three month period on behalf of the City shall be reimbursed to
