Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #91-03-061 <br /> <br />RESOLUTION APPROVING STEVEN <br />ASSESSMENT APPEAL SETTLEMENT <br /> <br />M. BLAKEMORE <br /> <br />SPECIAL <br /> <br /> WHEREAS, the City, by its Improvement Project #89-15, installed sanitary sewer, storm <br />sewer, water and bituminous surfacing on Dolomite Street N.W.; and <br /> <br /> WHEREAS, on September 5, 1990, the City adopted Resolution #90-09~303, which <br />Resolution adopted the special assessment roll for said Improvement Project #89-15; and <br /> <br /> WHEREAS, PIN 34-32-25-42-0003, which is property address 13659 Dolomite Street <br />N.W. owned by Steven M. Blakemore, was assessed $14,056.20, which was considered a two <br />unit assessment; and <br /> <br /> WHEREAS, the Blakemore parcel was assessed two units based on the fact that this <br />parcel can be subdivided, pursuant to existing zoning regulations, into two parcels; and <br /> <br /> WHEREAS, Mr. Blakemore objected to the two unit assessment and appealed this <br />assessment to District Court for review; and <br /> <br />WHEREAS, the Blakemore parcel as of this date has not been divided into two parcels; <br /> <br />and <br /> <br /> WHEREAS, the City Council desires to amicably settle Mr. Blakemore's District Court <br />Appeal without the necessity of incurring time and legal expenses for both parties; and <br /> <br /> WHEREAS, the City Attorney has negotiated a settlement with Mr. Blakemore which the <br />City Council finds is in the best interest of the City and which settlement is outlined below. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City's Finance Officer is directed to amend the assessment roll adopted September <br />5, 1990 by Resolution #90-09-303 to reflect that PIN 34-32-25-42-0003 (the Blakemore <br />parcel) shall be assessed for one unit only, in the total amount of $7,028.10. <br /> <br />2) <br /> <br />That the City's Finance Officer is directed to place a deferred assessment on PIN 34-32-25- <br />42-0003 in the amount of $7,028.10 to be reflected on the City's records only with the <br />provision that said deferred assessment is to be paid, together with accrued interest, in the <br />event this parcel is ever subdivided into two parcels by its owner. <br /> <br />3) <br /> <br />That the City's Finance Officer is directed to apply to the Anoka County Auditor's Office <br />for an abatement as to PIN 34-32-25-42-0003 in order to delete from said PIN one unit or <br />$7,029.10 from the previously certified assessment of $14,056.20 which was originally <br />certified pursuant to the assessment roll adopted by Resolution g90-09-303. <br /> <br />4) <br /> <br />That the City's Finance Officer is directed to issue a check drawn on City funds in the <br />amount of $500.00 to be payable to Steven M. Blakemore. This check is given <br />inconsideration for settlement of District Court lawsuit. <br /> <br /> <br />
