Councilmember Beyer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #91-04-084 <br /> <br />RESOLUTION RECEIVING AND CERTIFYING THE PETITION REQUESTING <br />THE VACATION OF STREET RIGHT-OF-WAYS LOCATED IN THE GATEWAY <br />NORTH INDUSTRIAL PARK SUBDIVISION <br /> <br /> WHEREAS, the City has received a petition to vacate certain street fight-of-ways in the <br />Gateway North Industrial Park Subdivision; and <br /> <br /> WHEREAS, the City Administrator has found the petition to be of the correct percentage <br />of lawful signatures of affected property owners; and <br /> <br /> WHEREAS, the City Administrator has found the petition to be in accordance with the <br />City Charter and Minnesota Statutes concerning street fight-of-way vacations; and <br /> <br /> WHEREAS, the petitioners have submitted the required application and deposits for the <br />vacation process. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That a certain petition requesting the vacation of a portion of 142nd Avenue N.W. and <br />Limonite Street N.W. in the Gateway North Industrial Park Subdivision has been filed <br />with the City Council on April 23, 1991. The petition is hereby declared to be signed by the <br />required percentage of affected property owners. This declaration is made in conformity to <br />the City of Ramsey Charter 12.06 and Minnesota Statute Chapter 412. <br /> <br />2) <br /> <br />That the petition is hereby referred to the Ramsey Planning and Zoning Commission to <br />conduct a public hearing at its convenience to hear resident's input and to report back to the <br />City Council as to the action that should be taken. <br /> <br />3) <br /> <br />That the petition has been found to contain the signatures of 60 percent of the affected <br />property owners. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Hardin and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gilbertson <br />Councilmember Beyer <br />Councilmember Hardin <br />Councilmember Peterson <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br /> <br />
